About the Committee

The Mediation Committee focuses on laws, practices and procedures relating to the mediation, conciliation, and negotiation of transnational disputes, as well as other alternative dispute resolution (ADR) processes. The committee seeks to advance the information available to the international legal community about such processes and techniques for implementing them; to contribute to the development of improved practices and ethical standards in the field; and to draw attention to legal developments and problems relating to mediation and ADR.
 
The committee also has a subcommittee devoted to developments related to the UNCITRAL Model Law on Mediation.
 
Additionally, the Mediation Committee works with the following IBA committees to form the Dispute Resolution Section:

Country guides 2015/2016

The Committee is producing a series of country guides giving an overview of mediation in each jurisdiction. More guides will be added in due course.


Download the report of the Subcommittee on the UNCITRAL Model Law on International Commercial Conciliation.

The IBA Mediation Subcommittee on the UNCITRAL Model Law on International Commercial Conciliation (MLICC) is leading a new project to conduct a major international survey on the adoption of the Model Law on Conciliation in different jurisdictions.

The subcommittee has prepared a questionnaire to find out how the MLICC compares with the existing mediation or conciliation practice in the following key areas:

  • Statute of limitations (Article 4 footnote 3 MLICC)
  • Confidentiality, admissibility and privilege (Article 8, 9 and 10 MLICC) 
  • Enforcement of settlement agreement (Article 14 MLICC)

The questionnaire comprises of the following documents:
