Cleaning up the mess: restructuring and insolvency approaches worldwide, 16-18 May 2010, Hamburg

This conference will be a forum to explore the different ways of saving businesses in trouble and will enhance each participant’s knowledge not only in cross-border cases but also in combining in- and out-of-court restructuring tools and methods for the sake of all stakeholders.


UNCITRAL Practice Guide on Cross-Border Insolvency Cooperation now available

The UNCITRAL Practice Guide on Cross-Border Insolvency Cooperation was developed with substantial contribution from our section, over the course of several years’ work.

Adopted by UNCITRAL on 1 July 2009, the Practice Guide provides detailed information and guidance for insolvency practitioners and judges on practical aspects of cooperation and communication in cross-border insolvency cases.


Extraterritorial jurisdiction

The report authored by the IBA Legal Practice Division Task Force on Extraterritorial Jurisdiction (2009) is available to purchase in the IBA shop. This report focuses in particular on competition law, tort law, criminal law, securities law and insolvency law.


SIRC Executive Meeting May 2009

SIRC’s October 08 'Conference within a Conference' - Buenos Aires, 12-17 October 2008

Following on the success of its 'Conference within a Conference' format for the SIRC activities at the IBA Annual conference in Singapore (2007) and Chicago (2006), SIRC is once again presenting a 'Conference within a Conference' at the IBA Annual Conference in Buenos Aires in October, with five programmes aimed at insolvency, restructuring and credit topics, a SIRC members meeting and another spectacular SIRC Reception and Dinner. 34th Session of UNCITRAL Working Group V Insolvency Law - SIRC Delegation and Reception

SIRC once again served as the IBA’s official delegation to the 34th Session of UNCITRAL Working Group V (Insolvency Law) in New York, on 3 March 2008. Attached is a link to the working papers from that session.

On 6 March 2008, SIRC hosted a reception at the Harvard Club of New York City to mark the 34th Session of UNCITRAL Working Group V (Insolvency Law).

33rd UNCITRAL Working Group V Insolvency Law Reception

In addition to once again staffing the IBA delegation to Working Group V, SIRC hosted a reception on the occasion of the 33rd UNCITRAL Working Group V (Insolvency Law) Session in Vienna, on 5 November 2007 at Vienna's elegant Sky Bar Lounge.

SIRC Participation at the UNCITRAL 40th Annual Session and at the Congress 'Modern Law for Global Commerce', Vienna 25 June - 12 July 2007

From 25 June until 12 July 2007, the United Nations Commission on International Trade Law (UNCITRAL) conducted its 40th Annual Session in its headquarters in Vienna. During the first two weeks, the session’s work was mainly devoted to continuing and – almost finalising the work on another one of UNCITRAL's milestone projects in the field of international trade law, the Draft Legislative Guide on Secured Transactions. This document has been drafted, in an astonishingly short time, under the knowledgeable guidance of SIRC Enforcement of Creditors’ Rights Subcommittee Vice-Chair Spiros Bazinas. SIRC was represented at the 40th Session by SIRC member Paul Seiler who had also actively participated in previous deliberations on the Secured Transactions Guide, and by Co-Chair Alexander Klauser. The Legislative Guide to Secured Transactions is an ongoing project of UNCITRAL’s Working Group VI (Secured Transactions) and SIRC staffs the IBA’s official delegation to that project. SIRC’s delegation is also participating in the upcoming Working Group VI Session in New York in May 2008.

To celebrate its 40th anniversary, UNCITRAL organised, during the last week of the session, a prime international legal conference, the so-called Congress on 'Modern Law for Global Commerce'. The Congress covered practically all fields of international trade law in which the UN organisation is active in its task of promoting modernisation and harmonisation.

SIRC Reception on the occasion of the UNCITRAL Congress, Vienna 10 July 2007

To acknowledge the long standing co-operation which SIRC, like its predecessor Committee J of the IBA, has established with this UN organisation, and to congratulate UNCITRAL on its 40th anniversary, SIRC hosted a reception for the delegates of the Congress on 10 July 2007. The reception took place in the Wien Museum and was attended by 280 guests. In addition to the Congress delegates, SIRC had invited members of the Austrian insolvency bar and judiciary.

Among the guests were the Under Secretary General for Legal Affairs of the United Nations Nicolas Michel, the Secretary of UNCITRAL Jernej Sekolec, former Secretary of UNCITRAL Gerold Hermann, IBA Legal Practice Division Vice-Chair Hendrik Haag, and IBA Legal Profession and World Organizations Committee (LPWOC) Chair Tore Wiwen-Nilssen. SIRC was represented by Co-Chair Alexander Klauser, Insolvency Legislation Subcommittee Chair Brigitte Umbach-Spahn, and by Enforcement of Creditors’ Rights Subcommittee Vice-Chair Spiros Bazinas.

The SIRC reception for UNCITRAL was featured in Austrian media as a top event and led to several articles describing how the IBA contributes to the legislative work of UNCITRAL in various fields of international trade law.
