IBA honours young Spanish lawyer
The IBA has this year presented the prestigious Bernard Simons Memorial Award for the Advancement of Human Rights to Ms Maria Inés Miranda Navarro, a young Spanish lawyer dedicated to promoting and protecting human rights in the disputed territories of Western Sahara.

The award was presented at the IBA’s Annual Conference in Chicago by Ambassador Emilio Cárdenas, Co-Chair of the IBA’s Human Rights Institute and former permanent representative to the United Nations.

About the HRI

The IBA believes absolutely in the fundamental right of the world's citizens to have disputes heard and determined by an independent judiciary, and for judges and lawyers to practise freely and without interference.

In 1995, the IBA established the Human Rights Institute (HRI), under the Honorary Presidency of Nelson Mandela. The HRI is now a leading voice in the promotion of the rule of law worldwide.

Objectives of the HRI:

  • The promotion, protection and enforcement of human rights under a just rule of law
  • The promotion and protection of the independence of the judiciary and of the legal profession world-wide
  • The adoption and implementation of standards and instruments regarding human rights accepted and enacted by the community of nations
  • The acquisition and dissemination of information concerning issues relating to human rights, judicial independence and the rule of law

Activities
Through its worldwide Council and Committees, the HRI works to advance these by:

Rapid Response Mechanism:

  • A mechanism to ensure the speedy dispatch of high-level, independent missions to countries where there are signs of a sudden deterioration in the rule of law and independence of the judiciary. Recent missions have taken place in Ecuador, Russia, Venezuela and Equatorial Guinea. All reports are available online in the relevant country sections.

Capacity Building/Technical Assistance:

  • The HRI undertakes capacity building through long-term programmes of support to law societies. Technical assistance programmes have also been established to provide advice in the area of legislative reform. Some recent projects include: Afghanistan, Malawi, Mozambique, Swaziland and Zimbabwe.

Trial Observations

  • The HRI sends independent experts to observe trials around the world to encourage compliance with fair trial standards and monitor and report upon legal proceedings. Most recent trial observations include Thailand.

Training:

  • The HRI has organised a number of training programmes for lawyers, judges and prosecutors in international human rights law and humanitarian law. Most recently for Iraqi jurists.
  • The HRI, together with the United Nations has produced a manual for judges, prosecutors, and lawyers: Human Rights in the Administration of Justice, which is the core human rights training manual used by both organisations. Click here to view the Manual.
  • The HRI has developed a series of workshops for lawyers, judges and prosecutors for combating torture within the judicial sector. So far, workshops have been held in Kazakhstan, Turkey and Mexico.

Media:

The HRI 's media work and advocacy campaigns have galvanised international support to lobby for change. The HRI has raised the profile of judicial crises, particularly in Ecuador, Equatorial Guinea, Venezuela, Swaziland and Zimbabwe. HRI media work involves:

  • Interventions when lawyers, judges, officials of lawyer’s associations or others involved in the legal systems are threatened, detained or abused.
  • Press Releases
  • Radio programme, In the Balance, discussing human rights issues in Zimbabwe beamed into the country weekly.  

  • Publishing HRI News four times a year and various other publications.

Recent Projects:

  • Southern African Litigation Centre (SALC) based in Johannesburg, South Africa is the first organisation of its kind in the region dedicated to the training and support of lawyers litigating human rights and rule of law issues. A joint project of the HRI and the Open Society Initiative of South Africa (OSISA), the centre provides ongoing expert support as well and resources and training for lawyers taking cases that advance human rights, the rule of law, public interest and constitutional issues.
  • International Criminal Court Monitoring and Outreach Programme is designed to monitor and report on the work of the ICC. This includes the presence of an IBA observer at proceedings of the chambers, where particular attention is given to fair trial rights of defendants. It also works to increase knowledge and support for the ICC among the international legal community through educational programmes.
  • International Practise Diploma Programme was developed by the IBA and the College of Law. Two human rights Diplomas are currently available: Human Rights Law and Practise and Human Rights and Criminal Procedure.
  • Rule of Law Directory was developed as the first centralised, fully searchable, online database of entities engaged in rule of law work throughout the world. The Directory has been funded by United States Institute for Peace (USIP). To date, over 1,000 organisations have registered.
  • LegalBrief Africa is an innovative IBA electronic news diary that delivers a succinct weekly wrap-up of important, useful African legal news to lawyers across Africa and the world. It is premised on the fact that African lawyers need quicker access to more, better information and lawyers around the world need to know what's going on in Africa. LegalBrief Africa is funded by the IBA Educational Trust and the Open Society Initiative Southern Africa (OSISA).

Specific Advocacy activities have taken place in the following areas:

  • International Terrorism, through the IBA Task Force on International Terrorism.
  • A Comparative Law Survey on Freedom of Expression and the Administration of Justice, a joint project between the IBA and Article 19.
  • International Justice.
  • Creation of a Rule of Law Directory.
