Appointment of New Counsel and Request for Additional Resources by the Defence
Introduction
On 21 February 2007, Mr. Jean Flamme obtained the leave of the Pre-Trial Chamber I to withdraw from his position as Principal Defence Counsel for Mr. Lubanga. Consequently, on 20 March 2007 Ms. Catherine Mabille was chosen by Mr. Lubanga as his representative to fill the position of Counsel for the Defence. Ms. Mabille’s request for additional resources as a condition precedent to formal acceptance was refused by the Registrar. The Head of Victims and Counsel Division in the Registry publicly notified the Chambers and all parties of Ms. Mabille’s appointment. The Prosecution then filed submissions in anticipation of a Status Conference.
On 3 April 2007, Mr. Lubanga filed a ‘Clarification’ indicating that Ms. Mabille had not formally confirmed her appointment as Counsel and requesting the Presidency stay all acts or proceedings related to the Defence pending the effective appointment of Counsel. The Registrar subsequently filed observations in response detailing the basis for his refusal and requesting the Presidency to confirm that there was no legal basis upon which to consider Counsel’s request for additional resources without formal confirmation on her part.
