Proceedings Arising From the Withdrawal of Defence Counsel

 

The Presidency referred the case against Mr Lubanga to Trial Chamber 1, which it constituted on 6 March 2007. The Presidency also decided to suspend the transmission to the Trial Chamber of the record of proceedings of the Pre-Trial Chamber until new Defence Counsel is assigned to Mr Lubanga and has had adequate time to become familiar with the case. 

 

On 9 March 2007 the Appeals Chamber gave reasons for its decision of 23 February 2007 in response to the Defence’s application for a stay of proceedings.  The Appeals Chamber noted that Defence Counsel sought the leave of the Pre-Trial Chamber for his withdrawal pursuant to Regulation 78 of the Regulations of the Court, with leave being granted on 21 February 2007. Mr Lubanga therefore requested that the Appeals Chamber stay ‘all acts and proceedings likely to affect the rights of the Defence.’
