Prosecution’s Submission in Anticipation of a Status Conference
On 29 March 2007, the Prosecution submitted this filing in anticipation of a status conference to raise certain issues for the upcoming pre-trial and trial matters. The Prosecution addressed the instruction of expert witnesses, the disclosure of the identification of witnesses, the difficulties related to e-court protocol, proofing witnesses, protection of victims and witnesses, and what evidence would be admitted at trial.
The Prosecution foresaw requiring several expert witnesses in specific topics such as politics, military and historical aspects of the situation in Ituri, as well as experts on matters of children serving as victims and witnesses. Regarding e-court protocol, the Prosecution determined that the “meta-data” required by the court protocol had “little or no value.” The Prosecution also considered witness proofing to be important but prohibited by the decision of 8 November 2006. With regard to witness identification, the Prosecution indicated that it wished to disclose their identity only a short time before testimony to ensure that they would be adequately protected.
