Outreach in India


On 16 February 2008 a workshop on “Indian and South Asia Perspective on the International Criminal Court” was organised by the IBA in collaboration with the Bar Association of India, the Indian Society of International Law the Criminal Justice Society of India  and the International Committee of the Red Cross. The workshop was an opportunity to disseminate information and facilitate a debate among the legal professionals in South Asia on the relevance of the ICC to South Asian societies. The Deputy Prosecutor of the ICC, Mrs Fatou Bensouda, attended the workshop together with professionals from Afghanistan, Bangladesh, India, Nepal and Sri Lanka. The former Law Minister of India, Mr Ram Jethmalani, also gave an inspiring inaugural address at the meeting.

The workshop was attended by 80 lawyers and it was successful in addressing the scope of the work of the Court vis a vis the concerns expressed by states in the region. The workshop also gave an opportunity to practitioners to share experiences from different countries and draw some lessons learnt on the use of standards from the Rome Statute in countries which have not yet ratified it.

The initiative follows other ICC-related workshops organised by the IBA in partnership with key local institutions already between February 2006 and January 2007.  In 2006 the IBA held two workshops on the ICC in India. In partnership with the Bar Association of India and the Criminal Justice Society of India, the first workshop was attended by sixty leading Indian lawyers.  A second roundtable discussion was also organised with the Indian Society of International Law and drew together a cross-section of the legal community, civil society and academia.  In January 2007 a two-day workshop on the ICC was attended by 100 lawyers in addition to Professor Roy Lee from Colombia Law School and Dr. Rod Rastan from the OTP. The workshop addressed the shift from India’s position historically to present and reasons for India to support the ICC. Recommendations were made on outreach strategy on ICC in South Asia, including tailored seminars and conferences addressing states’ concerns on ICC.
