Client Protection Subcommittee
(A Subcommittee of the Professional Ethics Committee)
Overview
The aims and objectives of the Client Protection Subcommittee are to promote client protection to the public in all its forms, and in particular by:
-
promoting a better understanding of the 'public good' ideal associated with client protection funds. Client protection funds means funds established by the legal profession in jurisdictions around the world to reimburse loss suffered by clients of lawyers arising out of theft of trust money or property, or from lawyers' negligence
- providing assistance to IBA member organisations and other Bar Associations in establishing and/or steering new and existing client protection funds; and
- to promote consideration of 'best practice' and risk management initiatives in relation to the philosophy, policy, structure and operation of client protection funds and their strategies.

Constituent Projects
The International Bar Association, Client Protection Subcommittee has conducted a major survey with respect to client protection funds in jurisdictions across the globe. The purpose of this survey is to gather information which is crucial to a proper understanding of the client protection function in so far as it pertains to the legal profession, and the development of 'best practice' standards in client protection fund and negligence/malpractice compensation.
