It is never easy starting-up and growing a business never mind staying alive during the last twelve months. The pandemic has forced businesses to think and act fast in a bid to keep their doors open. We will hear from business on how they had to pivot their model and come up with a lifeboat strategy. No one knows how long the pandemic and its effect are going to be around for. It could be a few months or a few years. Start-ups always need to be ready for uncertainty, take opportunity as it presents itself, keep employees motivated, ensure investors are on-side and be aware of whatever governmental support is available if they are to stay alive and survive.

Session 5 – “Getting over the Tower of Babel” – an approach towards pan-European standards for model documents

The rationale and economics of venture investments in start-ups are substantially the same all over the globe, with similar deal terms and mechanics. Their implementation into legal documents is, however, surprisingly heterogeneous, even within such a limited region as Europe.

Standard model documents can substantially contribute to make venture investments in start-ups more efficient, if sufficiently accepted in the market. In 2017, a pan-European working group of lawyers came to the surprising conclusion that, despite substantial differences in national legislations, particularly in the area of corporate laws and governance, in some core area a pan-European standardization is achievable. Can we overcome the European Tower of Babel and find a common legal language?

The coordinators of the pan-European working group will discuss where and how a standardization is achievable, and where and why not. At the same time they will inform on the current status of the group’s work and on next steps.
