'No dispute' arguments under dispute resolution and dispute escalation provisions

Construction projects are notoriously dispute-prone. Indeed, it is not unusual for parties to be in dispute about whether they are, in fact, in dispute in a manner which triggers the dispute resolution mechanisms under the contract. As this article demonstrates, resolving the question of whether a dispute has in fact arisen requires detailed analysis of the particular contract being used as well as the caselaw which has grown up around such analysis.
