A webinar presented by the IBA Arbitration Committee
This webinar will present the IBA Arbitration Committee's Toolkit on Insolvency and Arbitration, published in March 2021. The Toolkit examines the intersection of insolvency and arbitration proceedings in 19 different jursidictions and develops practical guidance for arbitrators, counsel, and parties in navigating this issue.
The presenters will discuss the purpose of the toolkit and its key areas of focus. They will present some of the thorny issues that arise when an arbitration is proceeding and one party enters into insolvency in the same or a different jursidiction. They will also discuss the (sometimes drastic) differences in perspective taken on this question in the various jursidictions surveyed for the Toolkit.
