This session will discuss the investment climate in Francophone and Lusophone Africa and the challenges and opportunities they present. Cross-border transactions are becoming increasingly complex and considered disproportionately challenging and risky by businesses and legal advisors. Lawyers who are able to demystify these challenges will play a critical leading role in helping their own and/or their clients’ businesses grow in Africa. The panellists will share their experiences on projects and transactions and focus on recent developments.

Is the European regulation an appropriate model? • Responses to African legal fragmentation: What are the benefits of standardising financing contracts, harmonising regional legal systems and resolving disputes though arbitration?

With a large portion of its population without access to electricity, and rapidly growing economies and populations, Africa faces a unique challenge to cope with a soaring demand for energy. This session will explore how renewable energies have the potential to play a significant role in the continent’s energy transition in a reliable, sustainable and cost-effective manner. The panel will also focus on the challenges placed on regulators and financing institutions to create an enabling environment to meet investment needs and discuss how renewable energy projects in Africa should be financed, through a wise collaboration between governmental agencies, international NGOs and private investors.

What are the key issues that investors consider in determining whether and how to invest in Africa, and how can advisers and counsellors help them navigate the complex investment landscape? Panellists will discuss the most significant financial and legal risks to new investments in Africa and how those risks differ by region and sector. The panel will explore the sectors presenting the greatest opportunity for investment in the near-term as well as forecast the sectors that will emerge as promising targets of investment in the future. Panellists will also share what investors should look for in their legal counsel and what to expect from Africa-focused counsellors both within and without the African legal market
