SUMMARY:Joint development of offshore natural resources
DESCRIPTION:Since the signing of the UN Charter in 1945\, the evolution o
 f state boundary delimitation has been substantial\, although a relative
 ly large number of specifically maritime boundary disputes globally appe
 ar more or less intractable. These disputes are in no small measure driv
 en by concerns on the part of the states involved to secure access to na
 tural resources – perhaps\, especially hydrocarbons – which they know\, 
 or at least suspect\, are located within the area of the overlapping cla
 ims.\n\nThis session aims to address the extent to which joint developme
 nt (JD) initiatives can assist in resolving\, or at least reducing the t
 ensions in\, maritime boundary disputes\, not least by facilitating comm
 ercial development even where issues of sovereignty have not been finall
 y agreed. To this end\, the session brings together leading experts in t
 he fields of the international law of the sea\, environmental law\, mari
 time law\, energy law and other related disciplines.\n\nThrough their jo
 int development zones\, many states have placed themselves in an ideal p
 osition to benefit from the commercial opportunities thereby created. Ho
 lding the workshop in such a state would allow the governments of the tw
 o countries to showcase their achievement and explain how they overcame 
 obstacles\, thus offering other nations a tangible example of successful
  offshore cooperation.\n\nPart 1: a new paradigm?\n\nAs a consequence of
  JD\, many legal issues arise\, such as the effect of regimes on traditi
 onal ‘jurisdiction’ and ‘sovereignty’ concepts\, the effect of JD regime
 s on existent disputes\, the effect of JD regimes and boundaries dispute
 s\, and even the goal of ‘joint sovereignty’ on JD regimes.\n\nPart 2: d
 ay-to-day\n\nJD regimes also raise\, maritime issues\; maritime spatial 
 planning issues\; port and customs regulation matters\, effects on corpo
 rative structure under the regimes\; transfer of technology and intellec
 tual property issues\; tax issues\; regulatory jurisdiction matters unde
 r JD regimes\, bidding and financing under the regimes\; corporative int
 ernational liability under regimes\, and regimes and insolvency (applica
 ble law\, jurisdiction\, execution etc)\, among others.
