SUMMARY:Current developments in cross-border cooperation
DESCRIPTION:This session will look into new trends and developments in cr
 ossborder cooperation. Law enforcement agencies and regulators around th
 e world are improving their cooperation. There are cases where one agenc
 y will defer to the other and one will have primacy. There are other cas
 es where the enforcement authorities\nview themselves as having equal in
 terest in the resolution and will work in parallel\, sometimes divided u
 p the work geographically.\nThere may be situations where it is simply u
 nknown who the leader is\, and who will ultimately be responsible for th
 e resolution\,\nmeaning that different national agencies will pursue the
 ir investigations until they have reached a decision. These different sc
 enarios and competing interests in cross-border\ncooperation are signifi
 cant factors of uncertainty for companies and individuals facing investi
 gations in more than one jurisdiction.\nTheir lawyers are expected to un
 derstand what is going on in the background and navigate their client in
  the right direction – in terms of producing documents and witnesses and
  having\nto formulate responses to different agencies pursuing different
  agenda and/or priorities.\nLawyers also have to consider differences in
  legislation\, for instance how corporate and individual liability is es
 tablished in different jurisdictions. Some tools for the resolution of l
 argescale investigations\, such as DPAs are not be available in all juri
 sdictions concerned.\nThus\, a comprehensive strategy is required to res
 olve investigations in a multijurisdictional context. This session will 
 focus on the many\nfactors that need to be considered to formulate that 
 strategy.
