SUMMARY:Mind the gap: globalisation of product safety standards and how l
itigation sometimes leads or supplements the regulatory framework
DESCRIPTION:It is no mystery that consumer products are increasingly prod
uced for a global market. Governmental authorities are grappling with ho
w to regulate their local markets and coordinate efforts regionally or g
lobally to establish regulatory regimes that endeavour to:\n- achieve ac
ceptable levels of health and safety protection for consumers\, irrespec
tive of where in the world they may reside\; and\n- minimise the unneces
sary burdens borne by the regulated industry.\nWhere governmental action
is perceived to be moving too slowly\, or is failing to provide the app
ropriate level of health and safety protections\, private litigants may
act to try to 'speed things up' or 'fill in the gaps'.\n\nIn this sessio
n\, we will examine how these two forces (private litigation and governm
ental regulation) may act in concert or at odds with one another to infl
uence health\, safety and sometimes the redistribution of wealth in vari
 ous countries around the globe.
