SUMMARY:Mock trial: the briber’s dilemma facing parallel criminal\, arbit
ral and civil asset recovery proceedings
DESCRIPTION:Bribery and corruption occur throughout business\, and increa
singly lead to parallel criminal\, arbitral and civil proceedings. The p
roof of corruption in these three types of proceedings is subject to dif
ferent rules and practices. In particular\, privilege\, right against se
lf-incrimination\, admissibility of evidence and publicity apply differe
ntly. The Criminal Law Section's interactive and ever-popular mock trial
will explore how evidentiary issues are managed in criminal\, arbitral
and civil asset recovery proceedings by having the same persons examined
by an Italian criminal court\, an International Centre for Settlement o
f Investments Disputes (ICSID) arbitral tribunal and the English High Co
urt on the same set of facts.
