SUMMARY:Coordinated non-trial resolutions with and among government autho
 rities: a new way to enforce article 4.3 of the OECD Anti-Bribery Conven
 tion
DESCRIPTION:Non-trial resolutions\, formal and informal\, are by far the 
 dominant form of resolution of international bribery cases. Since the do
 uble jeopardy defence is not recognised by most jurisdictions in interna
 tional corruption cases\, companies and enforcement authorities face com
 plex issues when they address prosecutions\nthat can be brought in multi
 ple jurisdictions. Cooperation between authorities in the finalisation o
 f non-trial resolutions to resolve charges relating to bribery can be a 
 way to avoid multiple\, overlapping prosecutions in international corrup
 tion cases. This panel will discuss work currently underway in both the 
 IBA’s Non-\nTrial Resolutions Sub-Committee and the OECD Working Group o
 n Bribery to analyse and consider guidance on non-trial resolutions and 
 cooperation among member states.
