SUMMARY:Panel 5: Invoking human rights in climate change cases against pr
 ivate actors\, such as companies
DESCRIPTION:As the links between climate change\, protection of the envir
onment and human rights are being expressly recognised at the internatio
nal level\, there has been a proliferation of cases against states and g
overnments using rights-based approaches to tackle inaction on climate c
hange. International and regional human rights law is also being deploye
d in litigation against corporates by claimants seeking to establish acc
ountability for the harmful effects of climate change. This panel will h
ighlight the driving force behind this emerging trend\, discuss the lega
l bases of such claims and consider the likely trajectory of rights-base
d arguments against corporates in the future.
