DESCRIPTION:A utopian world might have uniform laws and enforcement. Bord
 ers create conflict of laws and enforcement problems even for well-recog
 nised rights ranging from the right to life\, liberty and freedom of exp
 ression\, to more complex rights under the right to freedom of trade suc
 h as intellectual property rights\, equal treatment in public procuremen
 t and the right to have free and fair competition.\n\nThe Indian legal s
 ystem has three well-defined roles: adjudication of civil disputes\, cri
 minal jurisdiction and a special writ jurisdiction exercised by the Indi
 an courts under the Constitution of India. Hamstrung by the world’s larg
 est and possibly the most litigious population\, historical pendency of 
 cases creates a mountain of arrears. Civil and criminal cases wind onwar
 ds through the court process taking years\, but India still offers predi
 ctability\, certainty and quick interim relief to compensate for the ‘pe
 ndency’.\n\nThe session will examine India’s legal system to suggest pos
 sible solutions that may be reported and acted upon.
