BIC Anti-Corruption Working Group
Purpose and scope
This Working Group, convened under the umbrella of the BIC, brings together a select group of lawyers from across the IBA to address the evolving and interconnected responsibilities of the legal profession in promoting integrity, transparency, and ethical practice worldwide, with a focus on the role of bar associations. While called an ‘Anti-Corruption’ Working Group, the scope of its work encompasses lawyers’ ethical roles, compliance issues, beneficial ownership, money laundering, terrorist financing and other such related concerns under the overall rubric of “Anti-Corruption issues.”
The Group’s work concerns:
- The role of bar associations in generating, upholding and supporting relevant rules of professional conduct, including setting standards, providing guidance, and fostering a culture of compliance.
- The role of the lawyer as a trusted adviser, counsellor, officer of the court, and guardian of the rule of law.
- Anti-Corruption - including raising awareness, promoting best practice, and strengthening lawyers’ contribution to combating bribery, fraud, and related misconduct.
- Anti-money laundering (AML) understanding and best practice, including the lawyer’s role in risk assessment, client due diligence, suspicious activity reporting (as applicable), and compliance with relevant domestic and international standards.
- Beneficial ownership transparency, including the lawyer’s role in ensuring accurate disclosure and preventing misuse of corporate structures.
- Terrorist financing including related issues of human rights.
- Legal ethics in a broad sense, covering supervision, conflicts of interest, confidentiality, independence, and professional integrity.
