Whistleblowing

The IAB’s LPRU and other IBA members have formed a working group to undertake a project on whistleblowing protection. The focus of the project is to identify key elements of whistleblower programs and frameworks across all sectors that the working group agree are essential for such programs and frameworks to be effective. We anticipate completing the project during 2018.
 
The IBA’s LPRU also has been engaging with the European Commission as it continues to develop its whistleblower protection framework. For example, in June 2017, Jane Ellis, the LPRU’s director, participated by invitation in an expert’s workshop on whistleblower protection. This follows the roundtable on the protecting whistleblowers: A legal framework, the LPRU co-hosted with the European Economic and Social committee on 15th September 2017   
 
Ms Beate Gminder, Secretary-General of the European Ombudsman’s Office, provided the keynote address. Participants included international experts on whistleblowing law and policy, as well as Members of the European Parliament and various European institutions.
 
The Roundtable provided an opportunity to learn about initiatives that stakeholders are currently undertaking (principally in Europe) to improve whistleblower protection; established through case studies elements of successful whistleblower protection frameworks; and, explored how to resolve issues of contention that commonly arise in relation to whistleblower protection. It also provided an opportunity for the IBA LPRU to identify how the legal profession can best contribute to and potentially work with stakeholders to improve whistleblower protection, which will inform the development of a broader IBA LPRU project in this area.
