Structuring investment in distressed assets: the post-pandemic challenge

The Annual IBA Taxes Committee New Era Conference targets younger and new IBA Taxes Committee members. This year the Conference is taking place online.

The panel will review treatment for the management of tax liabilities, losses and succession, for companies facing financial distress in cases of judiciary recovery and bankruptcy, as defined by different jurisdictions. They will also discuss how treatment influences the structuring of investments in distressed assets from a tax perspective, including: the funding mechanisms; the use of separate investment vehicles; mechanisms to further protect the investor from tax succession; and the use of accumulated tax losses.
