IBA Annual Conference Scholarships

Each year the International Bar Association (IBA), the world's largest international organisation of law societies, bar associations and individual lawyers engaged in transnational law, holds an Annual Conference, which attracts the participation of some 6000 lawyers from more than 100 jurisdictions. The IBA's Legal Practice Division (LPD), Section of Public and Professional Interest Division (SPPI) present informative and engaging sessions covering current topics of significance to lawyers throughout the world.

Young Lawyer Scholarships

The Annual Conference working sessions are complemented by a full social programme which provides the opportunity for delegates to meet, establish and maintain business contacts and friendships with peers of the legal profession worldwide.

Scholarships are awarded to young lawyers who wish to participate at the Annual Conference, but may find it financially difficult to do so.

These Scholarship opportunities are available to those who meet the following criteria:

  • 'Young Lawyer’ is defined as any lawyer up to and including the age of 35 at the time of the Conference.
  • Applicants must either be:
    • a fully qualified lawyer who is licensed/registered to practice as a lawyer with the relevant professional regulatory body; or
    • undertaking the qualification process (education and/or vocational) to pass the bar (or the equivalent qualification in the relevant jurisdiction) to become fully qualified, providing they hold a temporary or permanent licence to practice as a trainee, or are undertaking a training scheme that is recognised by the professional regulatory body.
  • IBA membership is not a requirement to submit application
  • Employees of the IBA, officers of any IBA entity and relatives of the above are excluded from the competition.
  • Previous winners of any LPD/SPPI Conference Scholarships are also excluded from the competition. All other applicants from previous years may reapply.
  • Each participant may apply for one Scholarship in a calendar year.

*Select Scholarships may have additional criteria.

The Annual Conference Scholarship award includes the following:

  • waived registration for the IBA Annual Conference;
  • accommodation while attending the conference;
  • contribution towards travel costs to attend the conference;
  • two years' free membership of the IBA; and
  • a waiver of either the following years' IBA Annual Conference registration fee or a waived registration fee to attend a speciality conference organised by the IBA.

1) Academic and Professional Development Committee

Essay topic: Smart or dishonest? Plagiarism, and the use of automatic essay-writing technologies and services, are an increasing problem for universities and other educators training students for the legal profession.​​​​​

2) Access to Justice and Legal Aid Committee

It is proposed that the 2024 IBA Access to Justice and Legal Aid scholarship be assessed through a presentation or essay on the Mexico Annual Conference Access to Justice session topic ‘AI and Access to justice’.

The following points should be discussed:

  • a) Impact of AI on the delivery and quality of judgments;
  • b) Challenges of Bias in AI regarding fairness, and ethical considerations in AI development for the legal sector;
  • c) Non-human justice and the capacity of AI systems, devoid of human emotion, to truly deliver justice;
  • d) Potential barriers to AI-driven legal services and strategies to address these barriers; and
  • e) Challenges of the use of AI for the legal profession, addressing the potential erosion of the human expertise.

Applicants can choose one of the following formats:

  1. A TED Talk-style presentation of no more than 10 minutes length and, while slides can be used, over reliance on text heavy slides is to be discouraged. They should also be accompanied by an abstract of no more than 250 words; OR
  2. An essay of no more than 2500 words.

African Regional Forum

Essay topic: The challenges of cross border legal practice on the African continent. A case of harmonising training standards, ethics and practice of the profession? What is the way forward for Africa and the world?

Antitrust Section

Essay topic: A period of intense debate (at least in Europe) on competition law and sustainability has yielded some helpful antitrust agency guidance. There is now a transition to concrete action in certain jurisdictions –in terms of actual competitor environmental collaboration being waved through by agencies. At the same time, we also see instances globally of high-profile enforcement against agreements between competitors with the stated aim of building a sustainable future. Companies and their advisors point out that the lack of an aligned approach among agencies around the world makes implementing agreements to tackle climate change and other sustainability concerns for the good of the planet too risky. How can we achieve proactive global consensus among antitrust agencies on what the approach of competition law should be to sustainability agreements?

Human Rights Law Committee

Essay topic: Should companies be required to conduct Human Rights Due Diligence (HRDD) in the downstream part of their value chain, which includes the production, sale/licensing, and distribution of goods and services? If so, what are the expectations outlined in the United Nations Guiding Principles on Business and Human Rights (UNGPs), and how should companies implement downstream HRDD in line with these expectations?

Lifecycle of a green supply chain: from ESG-related contractual provisions to product claims and environmental litigation

The session focuses on the holistic view of the supply chain of “green “products, in particular energy, but also mechanical, chemical and electronical products. It will be addressed how and to what extent certain model clauses in contracts in the supply chain can provide a protection against liability risks. It will be further discussed how current risk of environmental litigation can be mitigated.

Healthcare and Life Sciences Committee

Essay topic: ‘Patient Access Programs/Patient Assistance Programs: Legal benefits and challenges for patients’

Synopsis: The focus of patient support programs is to address the problems that patients experience following a diagnosis or prescription from a doctor, so that patient outcomes can be optimised. New approaches to services "beyond the pill" of a drug, medical device or treatment administered to a patient are being used to achieve effective and safe outcomes for the patient. It is still early days, and much progress remains to be made in providing tailored programs to meet the unmet needs of patients, healthcare professionals (HCPs) and carers. Improving the compliant involvement of HCPs and patients in the clinical development process for future treatments would be a key objective.

The following points should be discussed:

The Pink Peso: How LGBTQI+ inclusion drives productivity and brings in business

The panel session will cover two areas: - the productivity gains that can be made in law firms by encouraging LGBTQI+ lawyers to bring their "whole selves" to work; and - the increasing requirements from corporate clients to show LGBTQI+ diversity in law firm pitches and client coverage teams.

Sexual minorities, refugees, and migration

The panel session will focus on the difficulties faced by same-sex families in establishing refugee status and migration.

Poverty and Social Development Committee

Essay topic: Anti-SLAPP is, on its own terms, seeks to control strategic litigation against Public Interest (SLAPP)

Civil Society Groups have used litigation to further social justice and in furtherance of social justice will at times criticize powerful interests in Society. These powerful interests have used SLAPPs as a method of silencing marginalized groups which have brought litigation to further environmental justice and social justice. Many jurisdictions have enacted Anti-SLAPP legislation to prevent the legal system from being used to quell legitimate social protest. This topic is designed to elicit a discussion about the injustice of using SLAPPs to prevent marginalized social groups from expressing their grievances. Essentially SLAPPs are an abuse of the judicial system and the rule of law is furthered by preventing the legal system from being used by the powerful against the expression of the voices for legitimate legal concerns.

  • Business Without Borders: Managing the Impacts of Corporate and C-Suite Mobility 
    • Executives and employees often need to cross borders to conduct business in our increasingly globalized marketplace, a trend that has increased significantly in view of changing attitudes toward remote and mobile work since the onset of COVID-19. Several countries issued temporary guidance relaxing standards concerning corporate residence, permanent establishment, or other nexus for tax purposes. Now that travel has reopened again, though, companies must grapple with the tax consequences posed by increased mobility among their personnel—particularly high-level executives. In your essay, describe how you would advise a foreign company on (A) the tax implications for the company of having its executives or personnel work in your jurisdiction and (B) an optimal strategy mitigate undesired tax consequences or risks. The essay should include a description of your jurisdiction’s current rules on when the presence of executives of a foreign company triggers tax consequences in such jurisdiction (e.g., does the foreign company become subject to corporate income tax, employment tax, etc.).
  • TOPIC 2: Treat-Ease: not if GAARs and PPT Can Help It 
    • The basic goal of tax treaties is to mitigate double taxation to facilitate cross-border business and investment activity. But as taxpayers’ organizational structures and transactions have become more complex—for nontax and/or tax reasons—tax authorities must consider whether certain treaty concepts still work or need to evolve to address new challenges. Tax authorities are increasingly wary of tax planning that they see as overly aggressive treaty-shopping or even treaty abuse. In your essay, (A) describe your jurisdiction’s approach to combat treaty-shopping in its own bilateral tax treaties (e.g., specific or general anti-avoidance rules, limitation on benefits, etc.), (B) discuss whether and why your jurisdiction has implemented (or should implement) the treaty-shopping standards in Action 6 of the OECD’s BEPS framework, and (C) if applicable, how the domestic anti-avoidance rules and the newly adopted rules under the OECD BEPS framework would (should) interact with each other.
