Developed over the last few years, largely in response to the growth of e-commerce, the online dispute resolution (ODR) field has progressed significantly in both theory and practice. These developments, however, have identified several potential ethical dilemmas and risks, particularly in relation to the increasingly integral role of the use of technology in how we negotiate resolutions to our dispute, with or without a third party.
The panellists will provide an overview of the ODR field and how its development sets the context for the range of tools and techniques encompassed in practice. Consideration of the ethical challenges raised by ODR practice raises key questions about the design of ODR systems and their governance in several countries.
