This webinar addresses the challenges and barriers to the full realisation of the human rights of the people of the Marshall Islands arising from the state’s nuclear legacy. It examines the enduring health, environmental and intergenerational harms caused by the US’ Nuclear Testing Program in the Marshall Islands between 1946 and 1958 and evaluates the principal legal and non-legal avenues available to the Marshall Islands to seek accountability, redress and remediation.
This webinar will bring together world-leading international law experts to discuss a range of prospective legal avenues for pursuing justice for the Marshall Islands, whose nuclear testing legacy has resulted in widespread radioactive contamination, forced displacement, the continued uninhabitability of Bikini Atoll and severe long-term health consequences, including elevated cancer rates and congenital abnormalities.
Panellists will examine pathways to justice, including petitions to the US Congress for environmental contamination remediation; the enforcement of awards issued by the Nuclear Claims Tribunal; litigation in US federal courts; proceedings before the International Court of Justice; and treaty-based claims under instruments such as the Treaty on the Non-Proliferation of Nuclear Weapons.
