Pre-packs are a popular restructuring tool with a growing number of jurisdictions having introduced pre-packaged insolvency proceedings during the last years. However, its practical use as a restructuring tool and effectiveness differs from jurisdiction to jurisdiction. The purpose of this panel is to provide, from a practical standpoint, a global view of pre-packs and analyse the opportunities, challenges and risks of conducting pre-packs from the perspective of debtors, shareholders and creditors. During this session we will also discuss how pre-packs and other restructuring tools available to market operators (eg, restructuring plans) currently co-exist and how pre-packs in corporate restructurings are expected to develop in the future.
