This panel will explore the complexities involved in the restructuring of distressed insurance companies. The primary goal in such restructurings is to ensure the most favourable outcome for policyholders. This discussion will delve into the optimal strategies for achieving this objective and the differences that arise across various insurance categories.

This panel will examine the full litigation spectrum from the pre-filing stage of when a company is in distress, to after a debtor has filed an insolvency proceeding and the post confirmation litigation (including fraudulent transfer and preferential transfers). The panel of senior litigators will also provide practical tips in the context of directors’ and officers’ (D&O) liability exposure to litigation and cross-border of enforcement/foreign recognition of judgments.

Pre-packs are a popular restructuring tool with a growing number of jurisdictions having introduced pre-packaged insolvency proceedings during the last years. However, its practical use as a restructuring tool and effectiveness differs from jurisdiction to jurisdiction. The purpose of this panel is to provide, from a practical standpoint, a global view of pre-packs and analyse the opportunities, challenges and risks of conducting pre-packs from the perspective of debtors, shareholders and creditors. During this session we will also discuss how pre-packs and other restructuring tools available to market operators (eg, restructuring plans) currently co-exist and how pre-packs in corporate restructurings are expected to develop in the future.

This panel will consider what are the main challenges facing the worldwide automotive sector throughout the supply chain, from original equipment manufacturers (OEMs) to auto parts manufacturers. The panel will discuss the legal mechanisms available in the key affected jurisdictions for rehabilitating, ‘recycling’ or simply winding-down distressed businesses in this sector.

In this interactive session the conference will hear from a panel of industry experts from around the globe on various issues arising from the highly topical subject of distressed mergers and acquisitions (M&A). The session will consider:
