This session will look at the following four aspects of asset management:

- trends in private equity: evolution of secondary transactions (general partner (GP)-led or otherwise) and continuation funds - focus of regulators;

- Alternative Investment Fund Managers Directive (AIFMD) review: the latest position;

- crypto - will the latest volatility lead to a co-ordinated approach to regulation in this area; and

- asset classes: is the potential slowdown going to show us a different asset class for limited partnership (LP) fundraising?

The panel will cover issues such as: how to recognise LGBTQI+ family units in the context of refugee status, migration and family reunification; the challenges involved in placement and housing of LGBTQI+ refugees and migrants; how to achieve positive integration outcomes for LGBTQI+ refugees in the resettlement country; and LGBTQI+ specific healthcare issues in the migration context, including mental health issues.

This session will take the form of an interactive roundtable, with each table hosted by a managing partner from a leading Latin American law firm. Participants will have the opportunity to engage directly with the managing partners, gaining personal insights into their journeys to leadership and the skills, challenges, and lessons learned along the way.

Topics to be discussed at each table include:
• navigating firm politics and partnership dynamics;
• building a personal brand and network within the region;
• leadership styles that resonate in Latin America;
• fostering diversity and inclusion at the top; and
• perspectives on preparing future firm leaders.

• buyer or seller’s market: where are we?
• EU Regulation on foreign subsidies;
• warranty and indemnity (W&I) insurance: going to the limits of coverage and case study; and
• the impact of new environmental risks on deal terms.

In this session the traditional method for the production of expert evidence in international arbitration will be scrutinised, namely to consider the advantages and disadvantages of resorting to a tribunal appointed expert. 

This workshop will explore the impact of global macro-economic trends and geopolitical situation on (i) market access, (ii) product design and (iii) fundraising in traditional and alternative structuring jurisdictions. This workshop will also cover the regulatory trends and challenges to overcome with respect to utilising offshore financial centres.

In March 2023, the European Commission (the ‘Commission) published a Communication and Annex amending its 2008 guidance on enforcement priorities concerning exclusionary abuses. This came in conjunction with a call for evidence to seek feedback on the proposed introduction by the Commission of guidelines on exclusionary abuses of dominance. The Commission is seeking to adopt their new guidelines by the end of 2025. This panel will explore the concepts contained in the draft guidelines with a view to determining how they fit with the approach agencies around the world are taking towards enforcing against misuse of market power.

Topical AI-related issues will be selected to stimulate a lively debate. Moderators on each table will introduce the table topic and the participants do the rest.
