This article provides an introduction to the Damages in International Arbitration (DIA) app, an interactive web application prepared by the ICCA-ASIL Task Force on Damages following five years of work. It has been prepared on the basis of the author’s contribution at the 2022 IBA Day Istanbul in March 2022 in the panel chaired by Mark Friedman and including David Dearman and Smitha Menon. The DIA guides users through the key legal, quantitative and procedural issues implicated by quantifying damages in international arbitration. The article is illustrated with some screen shots from the DIA web application and also refers to Friedman’s presentation on the suggested Quantum Academy (see pages 69–78).

Over the past few years, digital lending apps (DLAs) have greatly aided both business users and retail customers in India. However, to curb growing malpractice and the misuse of customers’ personal data, on 2 September 2022, the Reserve Bank of India (RBI) issued official guidelines to restrict the activities and improve the oversight of DLAs. All RBI regulated entities have until 30 November 2022 to put in place adequate systems and processes to ensure that all their digital loans are in compliance with the new guidelines.
In this session, seasoned mergers and acquisitions (M&A) experts will share lessons learned regarding financial mechanisms that tend to work well in M&A deals and pitfalls that may be encountered along the way.

Enforcement is rightly recognised as a key advantage of arbitration. That advantage has either been preserved or amplified in post-Brexit England. This article considers four significant changes in that regard. First, the English Courts are no longer bound by the recent judgments of the CJEU regarding the incompatibility of investment treaty arbitration with EU law. Second, the English Courts may have broader powers to compel arbitration. Third, it remains the case that the UK remains a party to the New York Convention in relation to enforcement of awards. Finally, England may be a favourable destination for enforcement of awards against sanctioned assets. Accordingly, Brexit is likely to be a big win for Arbitration.

Indian courts have adopted a novel and commercially pragmatic approach in ordering recalcitrant debtors to deposit money as security in aid of a claim in arbitration where there are clear admissions of liability or their defence is moonshine.
Economic sanctions add yet another layer to existing AML-CFT, anti-bribery, modern slavery and 'failure to prevent economic crime' developments around the world. Translating these regulatory regimes (mainly set up for banks & financial institutions) to professional services firms is challenging.
Lawyers want to play their part in countering crime (and to see any criminal actors removed from the profession). But navigating law firm collaboration across borders is becoming more difficult and complex when sanctions and AML compliance is not suitably tailored to the professional fields.
