This panel will describe, analyse and criticise the rules on interpretation of contracts and treaties commonly applied by international arbitrators between the principles of pacta sunt servanda and bona fide. In particular, this panel will address: 1) Use and misuse of the good faith principle in international arbitration 2) The contract not only obliges to what is written therein but also to what arises from the contract’s nature and the bona fide principle 3) The extension of the arbitration agreement to non-signatories 4) Is the treaty inserted into international law?
