Many countries to not have a mandatory professional indemnity insurance, and still others do not have disclosure requirements. As access to justice becomes a broader global issue, the ability to recover against an attorney becomes an important consideration. On the other hand, mandatory insurance may impose undue hardships on attorneys, and disclosure requirements may not be adequate to fully inform the public. Certain jurisdictions also require client security funds for reimbursement of clients in cases where the lawyer has committed malfeasance and ethical, if not criminal, violations. There is a currently a Bar Issues Commission task force exploring these issues, and they are part of the broader issue of the delivery of legal services. The panel will explore that work and the practical, regulatory and ethical considerations that should be considered in adopting policy in this area.
