Description
The shipping industry is in a new age of compliance. Gratuities in the industry have been a way of life, expediting port entry and the provision of necessary services throughout the world. However, when does a ‘gratuity’ cross the line and become a bribe or an illegal conspiracy under the various anti-corruption statutes in force? What are defences to prosecutions under such laws? Various United Nations and United States sanctions present additional challenges to vessel owners and operators requiring careful vetting of potential business to avoid crossing the ‘line’ – a line that is not always clear. The panellists in this session will discuss the anti-corruption and compliance issues facing the shipping industry and provide guidance for avoiding problems.
