Mediation of international commercial disputes: pitfalls, risks and opportunities

Monday 16 November (1600 - 1700)

Committee(s)

Mediation Committee (Lead)

Description

Quo Vadis transnational commercial mediation in 2020? International commercial mediation hit the headlines in 2019 with the signing of the long-anticipated Singapore Convention, highlighting and implicitly endorsing its decades-long growth in utilisation within many of the world’s jurisdictions. Just fifteen months after the initial signing of the Singapore Convention, this session will review the increasing use of mediation in international disputes, identifying both the opportunities presented in this post-convention era and the risks of which all dispute resolution professionals, be they barristers/litigators, arbitrators or mediators, must be aware. Chiann Bao, Arbitration Chambers, Hong Kong, will share an institutional point of view and her personal view as international arbitrator. Hansjörg Schwarz, TrojaPartner, Germany, will approach this question as a trained psychologist and negotiator with a view on the negotiation process as such. Karl Hennessee, corporate counsel Airbus, France, will address the future of international commercial mediation from the point of view of a conflict resolution specialist. The panel will be chaired by Natascha Tunkel, Gary Birnberg, Michael Mcilwrath and Martin Hauser. It will be co-moderated by Natascha Tunkel and Gary Birnberg.
