A webinar presented by the IBA Negligence and Damages Committee, supported by the IBA Litigation Committee and the IBA Mediation Committee

The purpose of this webinar is to explore how litigators handle tort disputes involving multiple jurisdictions and legal systems. We will examine strategic considerations such as forum selection, jurisdictional challenges, and choice-of-law analysis, and how these decisions can affect liability exposure and damages. We will also address practical issues in cross-border litigation, including managing international discovery, obtaining evidence from foreign parties, and coordinating proceedings across jurisdictions. Participants will gain insight into how differences in damages frameworks—particularly between US and non-US systems—impact litigation strategy, and how counsel can mitigate risk, limit damages exposure, and pursue efficient resolution through mediation and strategic settlement planning.
