Several countries have already incorporated military units designated as “space forces”. National defence and security issues are no longer limited to land, air and sea but have expanded into space. Protecting critical satellite infrastructure from cyber-attacks, securing and protecting space objects in general are becoming crucial tasks. Has the principle of neutral and peaceful use of space become obsolete? We will be exploring legal issues, ethics and resolving disputes around this question against the background of recent developments that point towards the space becoming a potential legal and physical “battlefield”.

The IBA Forum for Government and Public Lawyers was established this year, making it the IBA’s newest committee. The forum aims to provide a home for government and public lawyers from around the world.
This inaugural session will focus on the role and practice of the government and public lawyer, including around the values and objectives that ground public service, ethics and specialist skills, as well as consideration of public international law developments.
The session will be of particular interest to practitioners working in legal departments in local, national and international government and public bodies, including Parliamentary counsel, but will also provide a fascinating insight into the work of government and public lawyers for private sector lawyers.

The OECD and the UN have been addressing international tax issues differently to avoid or minimise double taxation. Initially, they had a different approach to tax passive income and technical services, as well as on the permanent establishment threshold. With the BEPS project after the 2008 financial crisis and the more recent Two-Pillar solution, the OECD has initially taken the lead to set new international tax rules - in the context of the inclusive framework of 140 countries - to avoid double taxation and to provide a new standard of fair taxation. In that context, a new international tax term arose: “market jurisdiction”. The UN is, however, still on the scene with its Model Convention’s Article 12B, with a renewed interest in contributing to and - why not - sharing the lead of the discussion. The panel will focus on where the two most important global tax policy drivers (i.e., the OECD and the UN) currently stand on the more relevant international tax issues, what their course of action seems to be driven by, whether it should be adjusted in some ways, and what to expect for the future.
