With an escalating climate crisis and economic and geopolitical uncertainties in the background, the debate around the risks of ‘greenwashing’ is – fortunately – becoming increasingly intense. Leaving the issue of state responsibility to one side, the spotlight of the debate seems to be on both the corporate and financial sectors, as market trends, consumer demands and regulatory pressures push for an integration of sustainability criteria into business models and strategies. Without covering all aspects of greenwashing, which is a complex and multifaceted topic, this overview intends to contextualise the debate with respect to past, present and future relevant market and regulatory developments in Europe, focusing in particular on the impact on financial intermediaries. Not forgetting the bigger picture, developments in the corporate sector are also briefly analysed through the same lens. Finally, some considerations follow on the cross-border nature of the greenwashing phenomenon and on how key jurisdictions, such as the United States and United Kingdom, are reacting to such a global phenomenon.
2025 was widely predicted to be ‘the year of exits’. The panellists will discuss the current state of the exit market across various jurisdictions, including which sectors have been most affected by a difficult environment for executing transactions and what recent trends have been observed in deal terms or structures.

The committee aims to enhance communication among lawyers worldwide on issues concerning indigenous peoples, and establish links with organisations like the UN Sub-Committee on Indigenous Peoples and the World Bank. The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. To reduce travel costs, the committee will utilise e-communication to advance its projects, programs, and publications.

The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.

Metaverse is growing exponentially with increasing support from investors and business entities. It provides real-life experiences in a simulated environment with unmatched potential for entertainment and earnings, which can be divided into two sorts of platforms in general. The first involves leveraging nonfungible tokens (NFTs) and cryptocurrencies to create blockchain-based metaverse startups. People can buy virtual products and create their own settings on web platforms. The second group uses the metaverse to describe virtual worlds in general, where people might meet for business or enjoyment. In addition, an array of technology solutions for closing contracts and solving disputes is available with the blockchain technology.

The pharmaceutical supply chain in India has traditionally relied on small neighbourhood pharmacies for last-mile distribution. Such pharmacies have proliferated to the point where there is often one on each street, and several within a square mile, in every city. Access to brick-and-mortar pharmacies has therefore generally not been a problem in India, at least in most urban areas, and the industry has prospered over the years.

This session explores the significance and development of private international law principles in the civil and commercial sphere, in times of crisis and conflict. Our panel of experts will take an in depth look at how legal obligations between private individuals and businesses may be (and are being) affected, including considering questions of governing law and jurisdiction, the recognition and enforcement of judgments and contractual relationships.
4th IBA Litigation Committee Conference on Private International Law
Twice a year, Florida State University and the International Bar Association offer the exciting opportunity to participate in a ground-breaking, distance learning, international law course. The application process included a 500-1000 word essay on what applicants currently consider to be the most pressing concern in International Human Rights Law. There was no right answer to this question, and we encouraged students to select a topic based on their current experience and interests.
This session will delve into state immunity in the context of delicta imperii, exploring the delicate balance between protecting sovereign interests and ensuring accountability of states for crimes under international law that are considered outside the scope of sovereign authority, such as crimes against humanity or the crime of aggression. After an introduction to the governing general principles, the panel will discuss the long-lasting dispute between Germany and Italy regarding compensation for victims of crimes committed by the Nazi forces in the Second World War and will explore potential paths for enforcement of claims against states in light of more recent armed conflicts.

The International Bar Association (IBA) Legal Policy & Research Unit (LPRU) has released the next episode in its Inspirational Legal Women podcast. It features Alessandra Nascimento Silva e Figueiredo Mourão, founding partner of Nascimento e Mourão Advogados in São Paulo, Brazil.
It has now been three years since the UK withdrew from the EU’s jurisdiction and enforcement regime, hence it is a timely moment to take stock of how this has affected litigating around the EU. Is the jurisdiction and enforcement landscape more complicated? What about obtaining interim relief and seeking to enforce that around Europe? Are the old difficulties of parallel proceedings back on the agenda? Are there other consequences arising from Brexit? This panel will review matters from the perspectives of the UK, the EU27 and from a ‘third party’ standpoint.

The Swedish, Norwegian and Danish governments have announced cooperation in the e-commerce sector, with the intention ‘to bring a halt to products that are harmful to health and the environment’
Beyond mere service providers, lawyers are a key component to the rule of law. Yet, their core mission to provide access to justice and the law is challenged like never before. From lawyers named and shamed for representing certain clients, to lawyers being prohibited to provide advisory services, to lawyers being expected to take an active role in the face of climate change, this panel will explore the blurred lines between morality and professional ethics in light of lawyers’ fundamental role. From ESG litigation to Russian sanctions, our panellists will discuss some of the burning ethical questions that the profession is facing.

Japan has finally started to make tangible progress in regard to reforming its value-added tax (VAT) framework to address the challenges brought about by the rapid expansion of cross-border e-commerce. Ongoing discussions are focused in particular on expanding the platform taxation regime to cover the cross-border sale of goods facilitated by online platforms offering fulfilment services, as well as on revising the de minimis import VAT exemption for low-value imported goods.

The borderless nature of the digital economy and electronic transactions has always been a challenge for law makers and enforcement bodies where their authority is generally limited to a jurisdictional territory. In this article, we discuss three recent developments of the Thai governmental authorities trying to tackle these challenges: VAT on overseas e-service providers; criminal complaints against an overseas cryptocurrency trading platform; and a draft royal decree regulating e-commerce platforms.

In this article we have analysed seven outstanding regulations in the amendment, namely: the scope of applications; data and data message; e-certificates; the use of e-signature and trust services; legal framework for applying e-contracts; synchronising the rights and obligations of the owner of the information system and the use of e-transaction accounts; and regulations on data collection, management and sharing among state agencies.

The pandemic accelerated the shift towards a more digital world and fuelled e-commerce growth, not just on a business-to-consumer basis but on a consumer-to-consumer basis as goods and services become more ‘fluid’ and transactions become less territorial.
