The rise in popularity of generative artificial intelligence (‘generative AI’) has ignited the discussion on whether junior employees can be replaced by it. Some have gone to the extent of questioning whether professionals, such as lawyers, can also be replaced by generative AI. Is it wise to replace junior employees or lawyers with generative AI? What factors should be considered before deploying generative AI tools in your business? To consider these questions, we first need to understand the basic workings of generative AI and what it can offer. Fundamentally, AI is intelligence that is not biological. The general understanding is that machines will be ascribed with this intelligence. These machines have the ability to interpret, learn from and process external data in a way that is similar to the capabilities of the human mind. Generative AI is a type of AI program that generates content from a data set. It uses deep learning, a type of machine learning system that behaves like a neural network to simulate the functions of a human brain. In other words, it can mimic human intelligence by exhibiting analytical skills to create new content. Not only can generative AI be utilised in chatbot programs to create text, but it can also be used in programs that can create images, sound or videos. This article will consider two major forms of generative AI, in the context of risks to businesses: chatbots using generative pre-trained transformer technology programs; and image generating programs.

It should be emphasised that the reform of private international law has also resulted in an extremely innovative solution over that period, that is, the overcoming of that now obsolete rule which obliged foreign judgments to exequatur before being effective within the Italian territory.
Reimagining Remedy: The view from the bench

The article analyses the validity of earn-out clauses and the legitimacy of the provision of a purely symbolic price in sale and purchase agreements.
Troubled times can spell increased obstacles to finding an agreement on price. This panel will first focus on some of the tools that can help to bridge the gap between a buyer and seller’s expectations and needs on price, while acknowledging that these solutions can raise their own challenges. For example, as one court noted, an ‘earn-out provision converts today’s disagreement over price into tomorrow’s litigation over the outcome’. The panel will thus also dig into how to draft and negotiate these necessary, but hazardous, tools.

After the failure of the consumer’s class action provided under the Italian Consumer Code, the reform of the discipline – to be in force in May 2021 – is expected to stimulate the utilisation of the collective redress instrument.
This session will explore key issues in wellbeing for law students and early practitioners, as well as how law schools and trainers can ensure they are managed appropriately. The issues will include, inter alia: incivility; the virtual work/study environment; diversity and inclusion; instilling work ethic; loyalty and commitment; and internships.

A summary of the IBA Aviation Law Committee’s activities at the IBA Annual Conference in Mexico City from 15–20 September 2024.
This session will explore the growing role of sustainable finance in Latin America as a tool to achieve the sustainability development goals (SDGs), focusing on the challenges and opportunities it presents for both public and private sectors in emerging markets. We will discuss the evolving regulatory landscape, the innovative financial instruments aimed at promoting ESG (green and social bonds, sustainability-linked bonds, etc.), the participation of traditional financial institutions in the sustainable finance market, the impact of international standards on local markets, the importance of a common taxonomy, regulatory and market incentives, and the relevance of disclosure practices.
The discussion will address how Latin America is designing strategies to achieve the SDGs, the role of lenders, investors, and companies in driving change, and the prospects of sustainable finance.

A number of studies point out that senior level women lawyers leave their firm, but not many such studies explain very well the reason why it happens and how we can prevent it. One of the reasons could be challenges of women lawyers in business development. This panel will introduce the concept of equity procurement, and relevant issues such as its pros and cons, as well as how it works at law firms, in collaboration with the Women Lawyers‘ Committee. One of the roles of the IBA is serving as a platform for business development (or procurement), and it is essential for the IBA and the D&I Council to seek more diverse and inclusive solutions to the issue.

This article will outline the development of China’s restrictions on the cross-border transfer of personal information (PI export), detailing PI export mechanisms provided by the Personal Information Protection Law. It will also explain the practical implications of the restrictions.
In the current global deal environment, nationalism and protectionism are flourishing and the parties must anticipate interference from national or supranational authorities, often with political agendas. This panel of leading global deal lawyers will focus on strategies to deal with the uncertainties imposed including unpredictable outcomes, delayed timing and generally increased risks. A particular emphasis on what we have learned the hard way - case studies of recent tricky transactions – will be employed.

This Oxford Union-style panel will delve into two issues, with one panellist defending the motion and the other rebutting it.
The first motion will be: ‘this house believes that international arbitral tribunals should rely more frequently on tribunal-appointed experts’ evidence’. While in some jurisdictions it is common practice for courts and arbitral tribunals to heavily rely on tribunal-appointed experts, in international arbitration this is rarely the case and the evidence gathering relating to complex technical and quantum issues is generally left to the parties and the party-appointed experts. During the motion the panellists will discuss the pros and cons of the two approaches.
The second motion will be: ‘this house believes that foreign investors receive adequate protection from investor-state arbitration when investing in Latin America’. Many Latin American states have gone through important political and regulatory changes over the last few years. Moreover, the only states that have denounced the International Centre for Settlement of Investment Disputes (ICSID) Convention so far come from the region. During the motion, the panellists will discuss the level of protection that foreign investors can encounter in Latin America.

Lawyers’ work touches almost every aspect of citizens’ lives. The legal profession plays an important role in upholding the rule of law, the laws of the land , seeking to limit Government excesses and defending freedom of speech . All essential elements in a strong democracy. Unfortunately, the value of the rule of law and of lawyers’ work is invisible and too often goes unnoticed. To remedy this situation, the IBA launched in June a landmark report giving visibility by measuring for the first time, in a comprehensive manner, the positive social and economic impact of the legal profession and of the Rule of Law. The report has also identified areas for improvement.
This Presidential session will offer an open debate about the role of lawyers and our contribution to society. The session will start with a short presentation by McKinsey of the main findings of the report followed by a conversation amongst the speakers and the audience, who may participate in the discussion with comments and questions.
