In early October, tech giant Google announced it had set aside over $1bn to pay media outlets to display curated content on its news apps, initially as part of a three-year programme. Google will pay publishers it chooses on a market-by-market basis to provide blurbs for the company’s Google News Showcase app (‘Showcase’) and to give readers free access to certain paywalled articles.
The panel will discuss new strategies implemented by shopping mall developers/tenants to persuade clients to visit the stores as the e-commerce sales increase rapidly.

This article will discuss some of the significant aspects of regulating payment companies in China, such as AliPay which provides alternative payment solutions such as open online virtual accounts, allowing the transfer of funds via a customer’s virtual account and bank account for the purpose of settling online transactions.

The Indigenous Peoples Committee addresses development issues affecting land and people from the legal perspective of those impacted, rather than developers, governments, or businesses. The committee aims to enhance communication among lawyers worldwide on issues concerning indigenous peoples, and establish links with organisations like the UN Sub-Committee on Indigenous Peoples and the World Bank. The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. To reduce travel costs, the committee will utilise e-communication to advance its projects, programs, and publications.
Year by year, the importance of e-commerce continues to grow. In many countries, it has become the dominant method for both consumers and businesses to purchase and sell goods and services. Cross-border transactions are the norm in this space, with significant implications for both regulation and dispute resolution. The Young Lawyers' Committee (YLC) aims to help young lawyers enhance their skills and networks through IBA programmes, conferences, and projects, while offering fresh ideas to the IBA. The Committee's activities promote the IBA among young lawyers globally and highlight membership benefits.
Key initiatives include the Young Lawyer Training Courses, which connect young lawyers with senior professionals, and encouraging involvement in various IBA divisions. Online or e-dispute resolution has long been a beneficial option for resolving business disagreements, even before the spread of Covid-19. With the current disruption and bans on travel and meetings in many countries, using remote mediation means that companies still have a means of solving problems and moving their businesses on. The positive experience of e-dispute resolution is such that it is likely to remain long after the pandemic has gone.
Revisit the scope of entertainers and athletes for tax treaty purposes (through article 17 OECD MTC) mainly in light of new activities on digital activities carried on by e-gamers, influencers and celebrities for instance.
Revisit the rules of sourcing and allocation between States with performance rendered in different States (international tournaments) with a special focus on e-games and digital activities for tax treaty purposes.

The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. Metaverse is growing exponentially with increasing support from investors and business entities. It provides real-life experiences in a simulated environment with unmatched potential for entertainment and earnings, which can be divided into two sorts of platforms in general. The first involves leveraging nonfungible tokens (NFTs) and cryptocurrencies to create blockchain-based metaverse startups. People can buy virtual products and create their own settings on web platforms. The second group uses the metaverse to describe virtual worlds in general, where people might meet for business or enjoyment. In addition, an array of technology solutions for closing contracts and solving disputes is available with the blockchain technology.
These activities trigger a number of legal issues, as for instance the applicable law, securities issues, NFTs and crypto currency regulations, IP enforcement and brand protection, tax issues, contract and tort laws, defamations laws and dispute resolution procedures.

The pharmaceutical supply chain in India has traditionally relied on small neighbourhood pharmacies for last-mile distribution. Such pharmacies have proliferated to the point where there is often one on each street, and several within a square mile, in every city. Access to brick-and-mortar pharmacies has therefore generally not been a problem in India, at least in most urban areas, and the industry has prospered over the years.
Also, it will address how sports events´ owners and producers are dealing with “active” fans who want to choose what, when and how to watch and how much the new players - Facebook, Amazon, Netflix, Google, Tik Tok, Kwai and other digital media – are willing to pay for sports content and how will their payback be.

This article examines the regulatory framework in Ukraine for the electronic communications sector, established by the Law on Electronic Communications and its primary goal of achieving harmonisation with European Union legislation. It highlights the key regulatory pillars applicable to the sector, including the principles of general authorisation for market entry, radio frequency spectrum management and enhanced end-user rights. The article also addresses the special regulatory regime under martial law, the sanctions framework and key future developments aimed at the market’s continued evolution.

Japan has finally started to make tangible progress in regard to reforming its value-added tax (VAT) framework to address the challenges brought about by the rapid expansion of cross-border e-commerce. Ongoing discussions are focused in particular on expanding the platform taxation regime to cover the cross-border sale of goods facilitated by online platforms offering fulfilment services, as well as on revising the de minimis import VAT exemption for low-value imported goods.

The borderless nature of the digital economy and electronic transactions has always been a challenge for law makers and enforcement bodies where their authority is generally limited to a jurisdictional territory. In this article, we discuss three recent developments of the Thai governmental authorities trying to tackle these challenges: VAT on overseas e-service providers; criminal complaints against an overseas cryptocurrency trading platform; and a draft royal decree regulating e-commerce platforms.

In this article we have analysed seven outstanding regulations in the amendment, namely: the scope of applications; data and data message; e-certificates; the use of e-signature and trust services; legal framework for applying e-contracts; synchronising the rights and obligations of the owner of the information system and the use of e-transaction accounts; and regulations on data collection, management and sharing among state agencies.

Both employers and employees are struggling to make sense of today’s application of pandemic employment, immigration, compensation/benefits/rewards, tax, discrimination and diversity practices.
This panel will address those issues and offer both legal and practical solutions and best practices for employers in their quest to retain talent post-pandemic without compromising future business imperatives brought on by potential industry downturns. Employer compliance, business demands and employee health and welfare will be addressed by discussing risks and benefits, needs and wants, law versus policy and current employment practices against possible terminations. The e-commerce industry has seen a sharp rise in recent years, largely due to global digitisation of economies with rampant adoption and development of technology. A further boost was provided to the industry by the Covid-19 pandemic as the world resorted to online shopping to acquire even the basic necessities.
DiversityInclusionThe expectation for equitable, socially inclusive, and environmentally sustainable practices and behaviour from extractive industries investors has never been greater. It is a challenging context for investors and industry players to achieve the right balancing act to meet these expectations, while continuing to conduct essential operations and develop projects that are necessary to meet global demand in the oil and gas and mining sectors. A lack of understanding about the benefits deriving from and necessity for continued investments in the extractive industries seems to permeate the dialogue around the extractive industries in many societies. Nonetheless, we still see many diverse approaches from investors, governments and communities across different parts of the world when it comes to investment in extractive industries, project development and community relations.
This session will attempt to discuss what is working in different parts of the globe, reviewing successful and not-so-successful experiences and how these practical examples can help guide the evolution of the extractive industries in the future.
In this context, this showcase panel will:
- address the viability of adopting some form of general standards for the extractive industries, seeking to offer a toolkit to balance the interests of extractive industry investors and companies, the development goals and rights of affected communities and global sustainability and environmental objectives;
- present speakers from different backgrounds who will debate key topics, including among other matters, free and prior informed consent, types of regulatory regimes, impacts on affected communities, human rights, economic participation and benefits sharing, fiscal stability and dispute resolution; and
- highlight the important role of the legal community to collaborate in these efforts and help bridge the diverse interests of different stakeholders involved in and affected by the extractive industries.
