As Thailand is a party to the New York Convention and has enacted legislation based on the UNCITRAL Model Law, a Thai court may refuse to recognize and enforce an arbitral award based on the public policy exception. Although many courts and practitioners around the world advocate for a narrow construction of this ground for non-recognition and enforcement, Thai courts have interpreted this exception relatively liberally. This brief article examines recent developments in this area to provide guidance to practitioners on how Thai courts have interpreted the public policy exception for recognition and enforcement of arbitral awards.

In this article, we discuss three recent developments of the Thai governmental authorities trying to tackle these challenges: VAT on overseas e-service providers; criminal complaints against an overseas cryptocurrency trading platform; and a draft royal decree regulating e-commerce platforms.

This significant milestone ensures equal marital rights for LGBTQI+ couples and sets a progressive precedent for the region, reinforcing Thailand’s commitment to social justice and human rights.
Amid worsening restrictions on free expression and political debate in Cambodia, two people have become the first to be charged under a controversial new lèse-majesté law.
The vaguely worded law was added to Cambodia’s criminal code in February, introducing offences against the dignity of the reigning sovereign. It has been widely criticised by rights groups and legal monitors.
The Panama Papers, a leak of 11.5m files from the database of law firm Mossack Fonseca, has provided considerable ammunition for critics of the legal profession. The leak highlights the creation of layers of secrecy that allow individuals and companies to hide assets from the authorities.

Many lawyers feel uncomfortable with the word ‘sales’. The idea of pitching, persuading or promoting can feel unnatural. And it’s no wonder – multiple studies show that salespeople are widely perceived as untrustworthy, and lawyers aren’t rated much higher. The encouraging part, though, is that great lawyers already apply the core principles of good sales. The real shift is in mindset: moving from ‘selling’ to consultative relationship-building – something most great lawyers are already doing when supporting their clients.

On 7 February 2023, Thailand’s Act amending the Thai Civil and Commercial Code (the ‘Amendment) took effect. The Act presents the key changes to the Thai legal landscape for M&A transactions, by adding a new merger scheme and modifies certain requirements relating to corporate governance of private limited companies to modernise the corporate formalities.
