He discusses Russian corruption, sanctions, election interference and seeking justice for Sergei Magnitsky, a Russian lawyer who exposed a large-scale tax fraud and died in pre-trial custody in November 2009.

Third party funding (TPF) provides greater access to justice in both arbitration and litigation. It allows the funded party to pursue a claim that otherwise, arguably, it would not be able to pursue. In England and Wales, TPF is voluntarily regulated through the Association for Litigation Funders (ALF). At the time of writing, there are no inquiries into law reform in relation to regulating TPF in the United Kingdom, however, in Australia, TPF regulation is fast approaching.

Enforcement is rightly recognised as a key advantage of arbitration. That advantage has either been preserved or amplified in post-Brexit England. This article considers four significant changes in that regard. First, the English Courts are no longer bound by the recent judgments of the CJEU regarding the incompatibility of investment treaty arbitration with EU law. Second, the English Courts may have broader powers to compel arbitration. Third, it remains the case that the UK remains a party to the New York Convention in relation to enforcement of awards. Finally, England may be a favourable destination for enforcement of awards against sanctioned assets. Accordingly, Brexit is likely to be a big win for Arbitration.

On the afternoon of Thursday 2 November 2023, at the IBA Annual Conference in Paris, the European Regional Forum lead the organisation of the automotive session titled ‘The European automotive and mobility service industry: transformation and revolution’. Contrary to its title the panellists came from different areas of the world, including Europe, India, Mexico and South Korea. During the session, panellists discussed issues relating to data privacy, developments concerning autonomous vehicles, the future of electric vehicles and more.
It is a common feature of financial fraud schemes for the proceeds of the fraud to be scattered across several jurisdictions, frequently through a network of connected entities. For the victims of fraud, the first step in attempts to salvage their investments will often be to seek a worldwide freezing order in the courts of the country in which the defendants and their activities are centred. In many such cases, however, the freezing order in the primary jurisdiction will not be sufficient

The IBA’s Criminal Law Section (made up of the Criminal Law, Business Crime, Anti-Corruption and Asset Recovery Committees) has closed 2024 with another successful conference; this time in Mexico City, where around 5,000 delegates gathered to exchange ideas, discuss the latest hot topics in the legal world and – of course – experience Mexican food, music and culture (including a memorable trip to a Lucha Libre wrestling competition).

The panel on digital assets at the 37th International Financial Law Conference in Venice was co-chaired by Dirk Bliesener, Vice-Chair of the IBA Banking Law Committee and partner at Hengeler Mueller in Frankfurt, and Benjamin Leisinger, member of the IBA Securities Law Committee and partner at Homburger in Zurich. It began by examining some of the fundamentals of crypto markets and the different asset standards.

The European Regional Forum (ERF), in particular its Professional Wellbeing Working Party (PWWP), organised a session on lawyers' wellbeing and ways in which we can make our law firms become better working environments. This session was additionally organised with the support of the IBA’s Presidential Task Force on Mental Health and wellbeing and the Professional Ethics Committee; it took place at the IBA 2023 Annual Conference in Paris.
