This article discusses the main legislative advances of the Peruvian competition regime since the entry into force of its first Competition Act, and the Peruvian Competition Authority’s most important achievements in recent years in investigating cartels and advocating in different sectors of the economy. In addition, this article analyses the challenges and setbacks that could undermine Peruvian Competition Policy and the main developments that can be expected in the future from the Peruvian Competition Authority.

Artificial intelligence (AI) is developing rapidly in China, with the number of patents and the size of the market both ranking highly among countries. However, this rapid development has posed new challenges to the legal framework, ethical norms and social governance, prompting China to continuously adjust and improve the relevant regulatory system.
The session will explore the challenges faced by farmers, food businesses, consumers, and environmental institutions and entities when dealing with the global tensions that concern the production and supply of food commodities and products, in relation with farming costs and financing. The panellists will discuss about the strategic and legal solutions to be adopted in order to prevent present and future stress conditions from happening throughout the healthy and less-healthy areas of the world.

The rise in popularity of generative artificial intelligence (‘generative AI’) has ignited the discussion on whether junior employees can be replaced by it. Some have gone to the extent of questioning whether professionals, such as lawyers, can also be replaced by generative AI. Is it wise to replace junior employees or lawyers with generative AI? What factors should be considered before deploying generative AI tools in your business? To consider these questions, we first need to understand the basic workings of generative AI and what it can offer. Fundamentally, AI is intelligence that is not biological. The general understanding is that machines will be ascribed with this intelligence. These machines have the ability to interpret, learn from and process external data in a way that is similar to the capabilities of the human mind. Generative AI is a type of AI program that generates content from a data set. It uses deep learning, a type of machine learning system that behaves like a neural network to simulate the functions of a human brain. In other words, it can mimic human intelligence by exhibiting analytical skills to create new content. Not only can generative AI be utilised in chatbot programs to create text, but it can also be used in programs that can create images, sound or videos. This article will consider two major forms of generative AI, in the context of risks to businesses: chatbots using generative pre-trained transformer technology programs; and image generating programs.
SustainabilityFocusHumanRightsThe session will explore the current regulatory framework for sustainable and responsible investment in agriculture and how this can contribute to the mitigation of the climate crisis. It will explore how lawyers in the private and public sectors can use a variety of legal tools including environmental and human rights law to promote sustainable and responsible investment in agriculture within their national contexts.

Inspired by other initiatives of ex ante regulation in digital markets, the Brazilian Bill 2.768/22 targets digital service providers that control essential access to certain services. If the bill is approved by Congress, it will cover various digital platforms, such as social networks, messaging services and search engines, imposing obligations related to transparency, fair service provision, data handling and access for professional users. Enforcement mechanisms include fines, operational restrictions and the creation of the Digital Platforms Oversight Fund to support regulatory activities. This article critically examines Bill 2.768/22, comparing it to the European Union Digital Markets Act and similar statutory provisions from other jurisdictions, most notably Article 19a of the German Competition Act and the United Kingdom's recently approved Digital Markets, Competition and Consumers Act. The article highlights shortcomings of the Brazilian Bill under discussion that would need to be addressed in order to avoid potential negative impacts in innovation and other distortions in Brazilian digital markets.
This session will explore the emerging technologies that are transforming agriculture, including artificial intelligence (AI), the internet of things, agricultural drones and precision agriculture, among other technologies.
We will discuss the implications of these technologies for increasing efficiency, productivity and sustainability in agriculture, as opposed to the challenges and concerns related to data privacy, ethics and regulation.

Mediation is on the rise internationally as a means to settle disputes in a cost-effective manner. Chinese parties appear to be increasingly interested in mediation as an option. This article examines the evolving landscape of mediation in China and internationally. It considers how mediation for Chinese parties is evolving and whether mediation is a good option for Chinese parties in cross-border disputes. Commercial mediation has seen remarkable growth, bolstered by a supportive PRC judicial system and legislative initiatives encouraging parties to find harmonious ways to resolve disputes. The article analyses the three primary types of mediation in China: people’s mediation, administrative mediation, and commercial mediation. It also looks at mediation rules and proceedings in common law jurisdictions, such as Hong Kong, Singapore, and the United States. The article anecdotally considers the cultural elements, emphasising the Chinese parties’ preference for evaluative mediation styles as a reflection of civil law. Through case studies of international disputes involving Chinese and US parties, the article illustrates the practical dynamics of mediation involving Chinese parties and underscores the importance of cultural sensitivity in international mediation. As Chinese parties continue to go global, mediation is emerging as an attractive option for efficient and cost-effective dispute resolution. This analysis assesses whether the promotion of mediation is yielding tangible outcomes and explores the future of mediation involving Chinese and foreign parties.

We were happy to see 110 participants in Munich on 27 March, in the unique location of Upside East for a day of discussions concerning the very challenging times that the automotive industry is now facing. Attendees had a chance to ease into the conference at the welcome cocktail which took place the evening before and it was good to see many familiar faces showing that the conference is becoming a familiar item on the IBA calendar.
As a consequence of the increase of cross-border mergers and acquisitions (M&A) in Asia and globally, combined with increase in interest rates, trade tensions and sovereignty protection, litigation has again become more prevalent following the closing of M&A deals. This session will discuss the most common post-closing litigation issues, and how to professionally handle them. Among other issues, the panel will discuss price adjustment, representations and warranties (R&W) litigation, and information rights post-closing.

The advent, and increased use, of social media have had a major influence on our lives and consequently, its presence in litigation is steadily increasing due to its immediacy and widespread reach.
Understanding and managing the questions raised and the complexities of litigation in the age of social media is therefore crucial. When and how can social media be used as a source of evidence? How effectively can information obtained from social media accounts be harnessed for discovery? Can service take place through social media and if so how?
We have assembled a panel of litigators across different jurisdictions and sectors who have amassed experience in dealing with social media in litigation. They will share valuable insights and provide tips on how to handle the impact that the use of social media can have in our day-to-day professional practice. The session will conclude with a workshop where participants will have the opportunity to brainstorm on real-life practical scenarios. This session is a great opportunity for young lawyers and law students to learn from our legal experts.
