Description
If the United Kingdom, including its legal profession, will not be allowed ‘to have its cake and eat it’, what possibly painful trade-offs are likely to be required by the European Union now that the Brexit trade talks have commenced? What impact will all of this have on London’s pre-eminence as a legal centre? Will UK lawyers retain: • the right to deliver legal services on a cross-frontier basis into the EU; • the right to establish and maintain branch offices in the EU; • recognition of their qualifications in the EU; • rights of audience in the European Court of Justice; and • legal privilege in EU competition and trade law investigations? On the other hand, what additional barriers might result for EU lawyers wishing to qualify and practice in the UK? Should the IBA seek to lobby on such issues and, if so, to what ends?
