Description

The requirements and restrictions applicable to the process of obtaining information and documents prior to litigation may considerably differ from one jurisdiction to another or depending on whether it is meant to be used in civil or criminal lawsuits. In particular, discovery is not regulated nor allowed in in most civil law countries. Conversely, in most common law jurisdictions litigation is not conceivable without a discovery pre-trial procedure. This panel will analyse the possibility and limits for using information or documents obtained in civil or foreign proceedings in domestic criminal cases considering the arguments on the admissibility of the evidence obtained abroad.
