Hilary Atherton
Biography
Hilary is an associate in our Intellectual Property practice, based in London. Advising on a wide range of IP matters (both contentious and non-contentious, and regularly with a cross-border element) Hilary works predominantly on brand management, trade mark, passing off, copyright and design matters for clients across a number of sectors, particularly Fashion and Luxury Goods, Media, and Food and Beverage. Hilary has acted for clients in the Court of Appeal, High Court, UK IPO, and at OHIM and has been involved in several mediations. Previous cases include Spear & Mattel v Zynga (relating to the SCRABBLE brand), Shark v Monster Energy Company & Coca-Cola Enterprises, Daimler v Sany Group (trade mark infringement action relating to Daimler's well known three-pointed star mark), easyGroup IP Licensing v easyJet Airline Company, and Nando's v Ndinos Peri Peri (trade mark opposition). Having graduated from the University of Oxford with a degree in Law, Hilary obtained a Postgraduate Diploma in Intellectual Property Law from the University of Oxford in 2012. Hilary has contributed to a number of legal publications, including the World Intellectual Property Report and the European Intellectual Property Review. She regularly reports and comments for legal and industry publications on IP issues relevant to the fashion industry, and is a member of the International Association of Lawyers for the Creative Industries (IALCI).
