A summary of the panel session at the IBA Annual Conference 2019 in Seoul, chaired by Bruno Maggi from the Young Lawyers’ committee, and Sebastian Ramos from the Academic and Professional Development Committee. The session was split into three parts: Challenging the cultural barriers and traditional approaches; What are law firms and law schools doing? and How to balance the specific knowledge with the broad perspective needed to solve the current complex legal cases.
The session will discuss which skills and experiences (work-life balance, office politics, business development, time management, networking, compensation, or others) have been the most important for the panelists in creating and continuing their legal career and what would they do the same or differently? What would senior lawyers have done the same or differently? What could junior lawyers do the same or differently?
IBA Annual Conference Mexico City 2024
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.
Our goals include: addressing the needs of professional organisations and individual members, increasing participation in the IBA, fostering cross-border collaboration among European lawyers and bars and supporting the Rule of Law and civil society. The ERF promotes professional development and networking opportunities through our many initiatives.

The independence of lawyers and free exercise of the legal profession is under threat around the world. Lawyers are subject to attacks and violations of their rights in staggering numbers. This panel will examine relevant protections in place for lawyers, the gaps and failures in their enforcement, and how to make improvements moving forward. We’ll hear from lawyers who have been politically targeted, persecuted and arbitrarily detained as consequence of their legal representation or advocacy. We’ll also hear from experts who are committed and mandated to protect the independence of lawyers.

With increasing evidence that ED&I directly contributes to business outperformance, many business leaders today are looking to up their game in this space. How can we afford not to take this agenda seriously?
Domestic insolvency procedures and international arbitration have been locking horns on and off throughout the world – and Ukraine is no exception. At the same time, the emergence of insolvencies were more or less predictable, thus making dispute resolution strategies somewhat easier to build. The 2020 quarantine changed this status quo immensely. The lockdown shook up supply chains, suspending or closing many businesses.

Italy welcomes legislative changes that represent a clear sign of greater awareness of diversity, equity and inclusion (DE&I) issues and urges employers towards a rapid cultural change, where human resources (HR) personnel can play an important role. Therefore, the attention is switching from more traditional areas of employment law to new ambits where lawyers can effectively collaborate with clients to shape forward-looking organisations.
Humans have constantly migrated through the centuries, and often such moves are driven as much by events at home as much as by the attraction of a new place. Expatriation and pre-immigration planning have long been key concerns for international wealth planning. Different considerations today can drive migration, but for those families looking to lower their overall effective tax rates a permanent move must follow a process and sometimes comes with an initial fiscal cost. In this session we focus our discussion on departure rules and tax implications when leaving a jurisdiction. We also consider whether the clients might be at risk of not truly severing tax residency ties particularly where they still have family and businesses in the original jurisdiction.

After a brief introduction of the six main topics and the corresponding moderators by the chairpersons, the auditorium was divided into a total of 12 tables, two tables with one moderator per topic. The moderators had each prepared their topic in advance with a list of questions so that the results of the two tables per topic were comparable. The results were then compared and summarised by the moderators after a discussion lasting around 30 minutes. The results thus obtained were then presented by the moderator teams for each topic.

With judgment of 14 September 2023 in EXTÉRIA sro v Spravime sro, the European Court of Justice (ECJ) decided on the interpretation of Article 7(1) of Regulation (EU) 1215/2012 (‘Regulation Brussels I bis’), in the context of a contract to enter into a future contract of franchising.

The rise in popularity of generative artificial intelligence (‘generative AI’) has ignited the discussion on whether junior employees can be replaced by it. Some have gone to the extent of questioning whether professionals, such as lawyers, can also be replaced by generative AI. Is it wise to replace junior employees or lawyers with generative AI? What factors should be considered before deploying generative AI tools in your business? To consider these questions, we first need to understand the basic workings of generative AI and what it can offer. Fundamentally, AI is intelligence that is not biological. The general understanding is that machines will be ascribed with this intelligence. These machines have the ability to interpret, learn from and process external data in a way that is similar to the capabilities of the human mind. Generative AI is a type of AI program that generates content from a data set. It uses deep learning, a type of machine learning system that behaves like a neural network to simulate the functions of a human brain. In other words, it can mimic human intelligence by exhibiting analytical skills to create new content. Not only can generative AI be utilised in chatbot programs to create text, but it can also be used in programs that can create images, sound or videos. This article will consider two major forms of generative AI, in the context of risks to businesses: chatbots using generative pre-trained transformer technology programs; and image generating programs.
Nowadays, failure to properly address how diversity and inclusion (D&I) issues can have a detrimental impact on dealmaking. Are pay equity issues and D&I topics board-level responsibility? D&I is key to successful post-transaction employee integration and, ultimately, employee retention and engagement.

This article will outline the development of China’s restrictions on the cross-border transfer of personal information (PI export), detailing PI export mechanisms provided by the Personal Information Protection Law. It will also explain the practical implications of the restrictions.
As a result of major crises such as the USA-China commercial battle, continuing economic effects of Covid, run-away causes by socialist-communist political movements in some countries, and the current European entanglement with transparency regulation, asset protection has re-emerged as a critical part of private client planning. There is a demand on lawyers to address the needs of personal security, family migration, political abuse, financial and market volatility, family business internationalisation, rather than solely focusing on tax. Mediation is on the rise internationally as a means to settle disputes in a cost-effective manner. Chinese parties appear to be increasingly interested in mediation as an option. This article examines the evolving landscape of mediation in China and internationally. It considers how mediation for Chinese parties is evolving and whether mediation is a good option for Chinese parties in cross-border disputes. Commercial mediation has seen remarkable growth, bolstered by a supportive PRC judicial system and legislative initiatives encouraging parties to find harmonious ways to resolve disputes. The article analyses the three primary types of mediation in China: people’s mediation, administrative mediation, and commercial mediation. It also looks at mediation rules and proceedings in common law jurisdictions, such as Hong Kong, Singapore, and the United States. The article anecdotally considers the cultural elements, emphasising the Chinese parties’ preference for evaluative mediation styles as a reflection of civil law. Through case studies of international disputes involving Chinese and US parties, the article illustrates the practical dynamics of mediation involving Chinese parties and underscores the importance of cultural sensitivity in international mediation. As Chinese parties continue to go global, mediation is emerging as an attractive option for efficient and cost-effective dispute resolution. This analysis assesses whether the promotion of mediation is yielding tangible outcomes and explores the future of mediation involving Chinese and foreign parties.

Efforts to innovate and re-imagine the delivery of legal services have taken a new turn, one that includes permitting alternative business structures and professionals other than lawyers delivering legal services direct to consumers. In a growing number of jurisdictions, regulators and the organized bar have begun implementing limited, supervised testing of new methods of delivery via a policy tool called a regulatory sandbox. What is a sandbox and how does it work? Can it really increase access and do so in a way that preserves professional values and public protection?
