The proliferation of class action regimes around the world has created significant risks for defendants who increasingly face parallel mass litigation or class action suits in a growing number of jurisdictions. How are these regimes developing in an antitrust context - are they opt in or opt out? What approach are the courts taking in terms of evidence and disclosure? This showcase will consist in a conversation between some of those top female leaders, the IBA female leadership and a leadership expert from a INSEAD business school.
The dialogue will address the qualities that such leaders bring to the management table and what firms can do to keep the positive vibe from female leadership once they have moved on and have been succeeded by other, male colleagues?
Female Leadership Excellence in Law Firms: coincidence or here to stay?
Based on research involving 64.000 people in 13 countries, John Gerzema and Michael D'Antonio identified that there is a shift in the types of leadership traits that are associated with success, morality and happiness.
The old masculine traits of aggression control, conflict and command are rapidly losing ground to behaviour, that is considered more feminine, like: selflessness, empathy, collaboration, flexibility and patience. Both male and female respondents in all researched countries expressed that this is the type of leadership which they consider most suitable for the rapidly changing and unpredictable world we live in. The researchers named this type of leadership: “The Athena Doctrine” (see TEDX Talk).
While these traits can be found both in men and women, it is clear that the Athena Doctrine particularly offers a great opportunity for women to soar in top positions. This session will discuss the following questions:
- How does the Athena doctrine translate to leadership in law firms?
- How do the leaders we have at the session relate to the Athena Doctrine?
- What particular features do they trust that they are bringing to the table?

The Company Law of the People's Republic of China (the ‘Company Law’) is the fundamental legislation that governs the socialist market economy system. Since its initial publication in 1993, the Company Law has undergone five revisions or amendments. The sixth revision of the Company Law commenced in 2019. Following four discussions by the Standing Committee of the National People's Congress and extensive consultation with various sectors of society, the latest draft was formally reviewed and approved on 29 December 2023. It is scheduled to come into force on 1 July 2024.
This panel will discuss the legal regime surrounding the allocation of landing slots at congested airports, and how aviation law specialists can optimise their advice to stakeholders.

On 1 August 2022, the Register of Overseas Entities (the Register) opened in the UK, in accordance with The Economic Crime (Transparency and Enforcement) Act 2022. This article summarises the current key factors any overseas entity owning or intending to own property in the UK must consider – as there are different dates for Northern Ireland and Scotland, the position that follows is that for England and Wales.
This slot will provide an author who has submitted a paper to be considered for the IBA Conference an opportunity to present their paper and findings.

The UK government’s Draft Registration of Overseas Entities Bill has come under renewed scrutiny. The Bill – which is due to go before Parliament later this year with the register going live in 2021 – would establish a publicly-accessible register of overseas entities that own or buy UK land.

Research carried out by the University of Warwick’s CAGE Research Centre has suggested significant gaps in the UK’s Register of Overseas Entities (ROE). The ROE was pushed through in summer 2022 in response to the Russian invasion of Ukraine. Its promise is that, in the UK government’s words, it’ll ‘require anonymous foreign owners of UK property to reveal their real identities to ensure criminals cannot hide behind secretive chains of shell companies’.

Twin pressures – the need to recognise EU funds and the pressure to be open to international investment – have led the UK post-Brexit to the conclusion that the current regime for recognising non-UK funds for sale to UK retail investors is inadequate. The solution is the creation of a new overseas funds regime that is streamlined and yet provides for the UK’s Financial Conduct Authority to have sufficient scrutiny of fund applications. More contentious in the new regime is the political 'overlay' that gives the UK's political authorities wide discretion to decide on country and fund type regulatory equivalence.

In the past few months, the Commission has adopted an unprecedented number of decisions allowing Member States to grant State aid to economic sectors and undertakings in financial difficulty due to the Covid-19 outbreak. Brazil’s digital health offering is rapidly evolving. The Brazilian National Digital Health Strategy 2020–2028 (Estratégia de Saúde Digital or ESD) and the National Health Data Network (Rede Nacional de Dados em Saúde or RNDS) lay down the foundations for interoperability, while the Brazilian Artificial Intelligence (AI) Plan 2024–2028 (Plano Brasileiro de Inteligência Artificial or PBIA) steers the health-focused AI initiatives. Despite having no AI-specific statute and the ongoing debate over Bill No. 2,338/2023, the Brazilian Health Regulatory Agency (Agência Nacional de Vigilância Sanitária or ANVISA) regulates AI-enabled software as a medical device (SaMD) according to the applicable risk-based rules, including Resolutions 657/2022, 751/2022 and 830/2023. Privacy governance, led by the National Data Protection Authority (Agência Nacional de Proteção de Dados or ANPD) pursuant to the General Personal Data Protection Law (Lei Geral de Proteção de Dados Pessoais or LGPD), shapes dataset access and model transparency. This article maps the relevant obligations, interoperability challenges and priorities for the creation of a safety- and innovation-balanced regulatory framework in Brazil.

Hybrid working will remain post-pandemic: the related digitisation of work has created increasingly unclear boundaries between work and private life, causing a potentially a negative impact on workers’ physical and mental health, as well as their safety at work. The right to disconnect will assume a fundamental role in the protection of workers. Well in advance of the pandemic, Italy adopted a specific provision on hybrid working in both the privuate and public sectors, including on the right to disconnect. This article aims to illustrate the Italian legislative framework in this respect.

With an escalating climate crisis and economic and geopolitical uncertainties in the background, the debate around the risks of ‘greenwashing’ is – fortunately – becoming increasingly intense. Leaving the issue of state responsibility to one side, the spotlight of the debate seems to be on both the corporate and financial sectors, as market trends, consumer demands and regulatory pressures push for an integration of sustainability criteria into business models and strategies. Without covering all aspects of greenwashing, which is a complex and multifaceted topic, this overview intends to contextualise the debate with respect to past, present and future relevant market and regulatory developments in Europe, focusing in particular on the impact on financial intermediaries. Not forgetting the bigger picture, developments in the corporate sector are also briefly analysed through the same lens. Finally, some considerations follow on the cross-border nature of the greenwashing phenomenon and on how key jurisdictions, such as the United States and United Kingdom, are reacting to such a global phenomenon.
