IBA Global Insight Dec 2016/Jan 2017 - The Shenzhen-Hong Kong Stock Connect, due to launch by the end of this year, is a clear move to entice more foreign investors to China’s domestic capital markets. The new scheme will include direct access to the country’s ‘new economy’ companies.
Consisting of four sessions over two days, these very dynamic and well-attended sessions enable you to select from a menu of hot topics in the IP, private M&A and technology sectors and participate in roundtable discussions.
Topics of current interest are selected to stimulate a lively debate. Moderators on each table introduce the table topic and the participants do the rest. Background knowledge or experience within areas for discussion is not required. Our menu will include hot and 'late breaking' topics in the areas of intellectual property law, internet law and mobile technologies, privacy and data protection, technology and contracting.
Discussion is usually around the interface of law, business, technology and culture, with a global focus. Many topics for discussion are often the subject of considerable public and media interest. In participating in the table topics, you will gain a deeper insight into these areas and be able to add your own comments.
The format is interactive networking. The sessions will provide you with a great opportunity to meet many other lawyers and to discuss topics of mutual interest with them; don't forget your business cards, e-cards and contact details to share. We welcome new participants in these discussions.

Database infrastructure and data‑centre‑driven cloud services have become the backbone of the global economy, underpinning competitiveness in finance, AI, logistics, healthcare, and media. Digitalization and AI hyperscaling are driving steep increases in electricity demand and reshaping grid load profiles, accelerating long‑term power‑purchase agreements and capital flows into renewables and storage.
Policymakers and regulators are scrambling to catch up with this tectonic shift, confronting the climate, water, land‑use, labour, and digital‑rights implications of hyperscale build‑out and AI‑driven demand. In Europe, the EU Taxonomy, Energy Efficiency Directive, and CSRD are turning data centres into test beds for “green digital” policy, with binding efficiency thresholds, granular energy‑and‑water disclosures, and direct sustainable‑finance consequences. The International Bar Association’s Human Rights Institute (IBAHRI) strongly condemns the recent assaults against Syrian Kurds by Turkish forces in northern Syria, and calls on Turkey to halt the attacks. Although Turkey has not ratified any of the additional protocols to the 1949 Geneva Convention, prohibitions of attacks on civilians are a norm of customary international law. Customary international humanitarian law provides that attacks must not be directed against civilians.
Following diminished investor support for ESG initiatives, conservative pushback against DEI policies and the retreat from multilateralism in the US, this session will examine the impact of these trends on North American companies and steps they can take to protect their trading and investment prospects within North America and globally by adapting their ESG and DEI policies and practices in response.

The International Bar Association’s Human Rights Institute (IBAHRI) supports the decision of the Chief Executive of Hong Kong, Carrie Lam, to withdraw the extradition bill that would have allowed suspects to be sent from Hong Kong to mainland China for trial. Nevertheless, the IBAHRI calls on Ms Lam to start an investigation into the police brutality meted out against those protesting the bill and journalists covering the humanitarian emergency.
On 8 December 2017, the European Commission decided that the International Skating Union’s (ISU) Eligibility Rules breached EU competition law. The rules provided that an athlete could be sanctioned for participating in an event not authorised by the ISU. The Commission thus examined whether the rules unlawfully restrict competition under Article 101 of the Treaty on the Functioning of the European Union (TFEU) by establishing a pre-authorisation procedure for third-party organisers and imposing sanctions
This session will consider whether lawyers and law firms should apply any ethical considerations in client selection.

The International Bar Association’s Human Rights Institute (IBAHRI) and Geneva Bar Association condemn the reported abuse of Covid-19 quarantine measures against a human rights defender in Vietnam. On returning to the country on 26 March 2020, Truong Thi Hà was quarantined alongside other travellers as part of the Vietnamese government’s response to the Covid-19 pandemic.
Regulators and litigators seem to be playing catch up with Big Tech and misuse of personal information as they try to reign in Big Tech's reach and power. We are starting to see multiple nation state regulators taking action or passing legislation to limit what they have uncovered about the misuse of personal data by Big Tech. We have also seen the varying successes and failures of class actions around the world taking on Big Tech. The International Bar Association’s Human Rights Institute (IBAHRI) welcomes the decision of the Inter-American Court of Human Rights (IACtHR) that holds Peru responsible for the arbitrary detention and rape of a transgender woman. The decision, made public on 6 April 2020, marks the first ruling by the IACtHR on a complaint of discriminatory torture against a member of the LGBTQI+ community.
The IBA Guidelines on Conflicts of Interest (the Guidelines) focus on when an arbitrator should disclose potential conflicts, as well as when he or she should simply not accept appointment. The Guidelines, even though non-binding, have become influential in the face of increasing challenges to international arbitrators and awards on the basis of arbitrator conflicts. The Guidelines are frequently considered by courts and arbitral institutions as providing relevant criteria for assessing the impartiality and independence of a challenged arbitrator.

4th Asia-based International Financial Law Conference

The Gambling Commission – which regulates gambling in Great Britain – announced in January that gambling businesses will be banned from allowing British consumers to gamble using credit cards from mid-April. The move follows a public consultation and is representative of the increasingly hostile environment for gambling companies in the UK.
In addition to effects on manufacturing processes and distribution along the supply chain, nearshoring involves the need for financing and planning for commercial/tax structures to operate in the nearshore jurisdiction as cost centres. This implicates issues that involve guarantees, project bankability, environmental, social and governance (ESG), tax and import/export.
The panel will explore guidelines for a financial institution’s proper due diligence on potential borrowers and the appropriate contractual protections in finance documents, in addition to the main opportunities for landing operations in Mexico and other popular nearshore jurisdictions.

Trends across the globe reflect a measured approach at limiting enforceability of post-separation non-competes in the context of workforce management. Growing voices against strangling of labour mobility under the garb of confidentiality and non-compete is being seen with immense distaste in employment rights movements. Several countries have demonstrated significant developments on banning non-compete in certain circumstances. India, however, has historically maintained a sustained approach at barring enforceability of post-separation non-competes, subject to limited exceptions. This article discusses these growing trends against non-competes, its limitations and jurisprudence in India, and popular alternate strategies adopted in practice to legally protect business interests.
