As in many other parts of the world, the age-old activity of gambling also finds various references in Indian history and mythology. The CJEU's 2022 London Steam-Ship decision exposed a critical gap in the Brussels I Recast Regulation: whilst judgments confirming arbitral awards can prevent recognition of irreconcilable judgments from other Member States, the absence of a lis pendens rule regarding arbitration proceedings creates significant risks of conflicting decisions and undermines legal certainty. The European Commission's 2025 report on the application of the Brussels I Recast Regulation acknowledges such irreconcilability risks and seeks to eliminate it. Against this backdrop, the Sorbonne Research Project has proposed a concrete solution. This panel will explore the diverging approaches across EU jurisdictions to this coordination challenge, examine the practical implications of the London Steam-Ship ruling and critically assess whether the Sorbonne proposal strikes the right balance between party autonomy, judicial efficiency and the fundamental principle of mutual trust underpinning EU civil procedure.

The German legislator has taken a step forward towards digitising German corporate law by introducing an online formation procedure for limited liability companies, which balances practical improvements and security needs. While the new procedure may help to save time and costs for certain non-German founders, the scope is limited, as only specific European identification documents are compatible and, furthermore, original (ie, paper) versions of certain documents are still required is some cases.

When the e-Commerce Directive was adopted within the EU in 2000, it was a foundational attempt to regulate online activity for businesses and consumers. Since then, social media platforms such as Facebook and companies such as Google and Amazon have transformed how we engage, purchase and share information online.
DiversityInclusionFrom an L&D perspective, the difficulties faced during the pandemic have made it clear that all organisations would be sensible to adopt more agile approaches to learning in order to improve performance, and embrace educational techniques that meet the opportunities and challenges of the adjusted world we now live in. One of the many dilemmas of L&D is figuring out how to use advances in technology as a means of engaging learners and improving access to learning for a more diverse audience with different needs and preferences. This session will be led by industry experts in learning design and delivery who will provide an insight into how a digital approach to learning can best serve learners of the future.

In March 2011, the International Bar Association (IBA)’s Legal Projects Team took up an important global initiative to examine the presence and role of online social networking within the legal profession and practice.
The rise in the frequency of online cross-border legal services, already in evidence before the pandemic but doubtless increased by home working and travel restrictions during the pandemic, poses challenging questions about whether bars’ existing regulation of foreign lawyers, often based on their physical presence, needs to be reconsidered in the light of digital advances.

Covid-19 and the remote prospectus drafting and verification sessions that it promoted, have affected the way in which part of the less formal diligence process is done. In some jurisdictions nothing may have changed, but in others the changes have been profound – and they seem here to stay. Is this good, bad or indifferent? An expert panel will consider whether the market has merely developed a more efficient way of working, or whether standards risk being eroded. The panel will analyse some of the new practices from an issuer and from an underwriter perspective, and an attempt will be made to formulate practical guidelines that safeguard the interests of investors while retaining efficiency gains made during the pandemic.

The proliferation of class action regimes around the world has created significant risks for defendants who increasingly face parallel mass litigation or class action suits in a growing number of jurisdictions. How are these regimes developing in an antitrust context - are they opt in or opt out? What approach are the courts taking in terms of evidence and disclosure? Which regimes seem to be ”claimant friendly”. For parties and legal practitioners involved in cross-border class actions, how can an effective antitrust class action strategy be developed to handle concurrent lawsuits in different jurisdictions? What insights can be gained to preserve the defense of a case in one jurisdiction without compromising positions in others?

At last, a flurry in appointments of female leaders at many of the world’s largest law firms has occurred. This reached cruising speed as from 2020 and has not stopped since. It should not stop!
This showcase will consist in a conversation between some of those top female leaders, the IBA female leadership and a leadership expert from a INSEAD business school.
The dialogue will address the qualities that such leaders bring to the management table and what firms can do to keep the positive vibe from female leadership once they have moved on and have been succeeded by other, male colleagues?
Female Leadership Excellence in Law Firms: coincidence or here to stay?
Based on research involving 64.000 people in 13 countries, John Gerzema and Michael D'Antonio identified that there is a shift in the types of leadership traits that are associated with success, morality and happiness.
The old masculine traits of aggression control, conflict and command are rapidly losing ground to behaviour, that is considered more feminine, like: selflessness, empathy, collaboration, flexibility and patience. Both male and female respondents in all researched countries expressed that this is the type of leadership which they consider most suitable for the rapidly changing and unpredictable world we live in. The researchers named this type of leadership: “The Athena Doctrine” (see TEDX Talk).
While these traits can be found both in men and women, it is clear that the Athena Doctrine particularly offers a great opportunity for women to soar in top positions. This session will discuss the following questions:
- How does the Athena doctrine translate to leadership in law firms?
- How do the leaders we have at the session relate to the Athena Doctrine?
- What particular features do they trust that they are bringing to the table?

The APEC Collaborative Framework for Online Dispute Resolution (the ‘Framework’) addresses the growing need for efficient and affordable resolution of cross-border B2B disputes, particularly for micro, small, and medium-sized enterprises. Traditional litigation and arbitration are often too costly and slow for low-value, high-volume disputes, creating a barrier to trade. Developed by APEC with input from UNCITRAL’s earlier work, the Framework establishes a decentralised network of accredited ODR providers who offer a standardised, tiered process combining negotiation, mediation, and arbitration. Key innovations include expedited timelines, simplified procedures, a single neutral practitioner, and cost proportionality. By enhancing accessibility, reducing costs, and building trust in digital trade, the Framework supports inclusive economic growth and smoother commercial exchanges across the Asia-Pacific region.
In this session we will discuss the areas where smaller law firms have potential strength and can concentrate their efforts in succeeding and competing against much larger and international competitors:
1. Collaboration (Do fee sharing and multidisciplinary models allow strength and depth to be brought to smaller firm clients? Can we be more competitive and profitable with collaboration and what forms?)
2. Costs, capital and fees (How to balance costs and fees?)
3. Culture (How can a positive and dynamic culture make the smaller firm an attractive destination for junior lawyers? How we boost diversity? How we treat generational exchange issues? How do we manage growth?)
4. Connections (How can informal and formal networks assist?)
5. Computers (how has artificial intelligence and technology levelled the playing field?)
