Description
An increasing number of companies are sold in auctions. Over the last few years, best practices to run an auction have been established, but M&A auctions are rarely specifically regulated by local law. Despite the commonalities, there are regional differences and legal challenges. Which law applies in a cross-border auction? Does the applicable law impose a duty to treat bidders fairly, or even equally? Where are the limits to ‘creating a competitive bidder environment’? The panel will give an overview, as well as discuss those and further issues.
