Political agreement was reached on 27 July 2025 between the European Union and United States on the imposition of ‘reciprocal’ trade tariffs, the removal of various regulatory barriers and commitments to investment levels. Irrespective of the posturing as to who the likely big winners and losers are in real economic terms when the more detailed terms of that agreement are finally fleshed out, it is clear that the agreement does not extend beyond trade in physical products. Trade in services, especially digital services, is conspicuously absent from the deal. This editorial assesses why that is, and why the status quo does not need to change much, if at all.

Cryptocurrency, digital platforms and metaverse taxation on digital services and trades (2023)

Due to the ways in which digital technology allows non-residents to do business without creating a physical taxable presence, countries are rushing to amend their tax codes and treaties to address this gap. Thus, in a world driven by intense research and development, gene therapies have taken centre stage for companies, regulatory agencies and researchers alike. In countries, such as Chile, where the regulatory framework remains underdeveloped, discussions on the implementation of specific regulations in this field are critical, otherwise, not only will research be hindered, but public health may also be put at risk.

The Pandemic’s Impact on Legal Work: A Comparative Analysis of Legal Frameworks, Practical Impacts and Innovation

As the Covid-19 pandemic continues to have an impact on our economy and social structures, it comes as no surprise that the way people work – and the digital tools used – differ substantially from our experience of pre-pandemic work. Across the globe, organisations are extending a suite of remote work options, including full-time remote work, hybrid remote work and flexible personalised plans. The legal profession is no exception to this trend, and in facilitating the shift, a variety of digital tools and services have been implemented to optimise the experience of remote legal work. These tools and services include virtual meeting platforms, digital hearing and filing platforms for courts, e-signatures, digital document review and e-discovery. The international uptake of digital tools and services in legal work signals a shift towards a new ‘normal’ in the profession. While being a lawyer was once synonymous with paper stacks and extensive physical libraries, digital tools and services have made the same world available through one’s laptop. The sustainability of the shift and our new ‘normal’ is also due in part to legislative reforms during the height of the pandemic that enabled an increased use of digital tools and services, and which in some cases continue to be in effect today. This article will examine how several jurisdictions, namely Australia, Belgium, India, Italy, Sweden and the United Kingdom, adapted their legislative frameworks to facilitate remote work, the impact of remote work on the legal profession, the various innovations adopted in the context of the pandemic and whether such innovations and associated changes were maintained after the lifting of associated restrictions.

Introduction to the China International Commercial Court and Procedural Innovations in Aid of Arbitrations in Hong Kong

This article provides an overview of the China International Commercial Court (CICC) and its ‘one-stop’ platform for diversified international dispute resolution, as well as the new developments and benefits that this brings to users of arbitration in Hong Kong, in particular at the Hong Kong International Arbitration Centre (HKIAC). It begins by introducing the purpose of CICC’s establishment, the composition of the CICC, and the functions of the CICC. It then introduces the significance of the HKIAC’s inclusion into the CICC’s ‘one-stop’ platform, as the HKIAC is the only arbitral institution outside Mainland China to be so included. This article explains the existing mechanisms and practices through which arbitration users in an appropriate Hong Kong-seated arbitration may seek interim relief and enforcement of arbitral awards in Mainland China. Finally, this article explores the potential developments for users through the CICC’s new mechanisms and their likely impact.

Procedural creativity in international construction arbitrations: a comparative analysis of institutional innovations in the US, Singapore and France

Arbitration is widely accepted as an effective dispute resolution mechanism for international construction disputes. This article will explore the extent to which various institutional rules have developed in a way that addresses the peculiar needs of disputants in the construction industry. The article shall briefly examine three of those specific needs and show how each has (or has not) been addressed by certain institutions. First, it will consider issues related to the cost and duration of construction arbitrations, specifically, procedural expedience including expedited procedures, procedures for securing interim relief and the correlation between high quantum claims and high arbitration costs. This article will then explore the suitability of existing discovery procedures for construction disputes. Finally, it will address issues that arise when, as is often the case, multiple parties or agreements are involved in a construction dispute. For each one of these needs, this article will seek to draw some tentative conclusions as to the extent to which certain institutional rules may arguably provide some tactical advantage to employers or contractors/subcontractors on construction projects, should they encounter a dispute that must be resolved by arbitration.
