Innovation in healthcare is primarily fuelled by intellectual property. The significance of intellectual property rights extends beyond merely establishing the ownership of inventions; they are also crucial for transforming these inventions into economic assets. By enabling inventors to market their innovations without worrying about imminent competition or imitation, these rights are intended to incentivise creativity and innovation.
The struggle to address the global access to justice and access to legal services crises continues, with the pandemic having taken its toll on those in need. Efforts to innovate and re-imagine the delivery of legal services have taken a new turn, one that includes permitting alternative business structures and professionals other than lawyers delivering legal services direct to consumers. In a growing number of jurisdictions, regulators and the organized bar have begun implementing limited, supervised testing of new methods of delivery via a policy tool called a regulatory sandbox.

The African Continental Free Trade Agreement (AfCFTA) is the world’s largest free trade area bringing together the 55 countries of the African Union (AU) and eight (8) Regional Economic Communities (RECs). The overall mandate of the AfCFTA is to create a single continental market with a population of about 1.3 billion people and a combined GDP of approximately US$ 3.4 trillion. As part of its mandate, the AfCFTA is to eliminate trade barriers and boost intra-Africa trade.

6th European Automotive and Mobility Services Conference
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

Political agreement was reached on 27 July 2025 between the European Union and United States on the imposition of ‘reciprocal’ trade tariffs, the removal of various regulatory barriers and commitments to investment levels. Irrespective of the posturing as to who the likely big winners and losers are in real economic terms when the more detailed terms of that agreement are finally fleshed out, it is clear that the agreement does not extend beyond trade in physical products. Trade in services, especially digital services, is conspicuously absent from the deal. This editorial assesses why that is, and why the status quo does not need to change much, if at all.

Due to the ways in which digital technology allows non-residents to do business without creating a physical taxable presence, countries are rushing to amend their tax codes and treaties to address this gap. This panel began their discussion with an example and tried to tackle the questions arising from their respective tax legislation and highlighted the potential gaps. Furthermore, the panel discussed which transactions should see taxes arise in regard to cryptocurrency, digital platforms and the metaverse.
At this session the Future of Legal Services Commission will present its third annual 'Heatmap' reflecting the issues that are top of mind for practitioners, educators and regulators, and will report on how we are collectively dealing with the challenges and opportunities involved in attracting and retaining new talent in the profession.

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Biennial IBA African Regional Forum Conference: future-proofing the African legal profession
The Agriculture and Food Section (AFS) focuses on the evolving intersection of agricultural and food law and policy. Addressing urgent issues such as equitable food production in the face of climate change, land use, food production and distribution, farmers’ rights, seed and biotechnology laws, food safety, and agri-tech. We also explore sustainable agricultural practices and investment strategies. As a dynamic and essential field, the AFS provides a platform to address critical legal challenges in feeding the planet effectively and sustainably.
The International Trade in Legal Services Committee's mandate is to monitor the work of the WTO globally and provide information and guidance to Bar Associations and Law Societies to answer questions potentially raised by trade negotiators from their own countries.
The session will take stock of the developments made in cross-border legal practice up to now, reviewing the jurisdictions having opened their legal services market to the practice of foreign lawyers and law firms and assessing what the experience has been. The session will also discuss the rising challenges to globalisation (eg, sanctions, decoupling and de-dollarisation) and the impact, if any, on trade in legal services.

The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Committee arranges a number of sessions on developments in maritime and transport law at the annual conferences of the IBA. The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. Formed by Bar Leaders, the Forum advocates for the principles of independent advocacy within the IBA. The Forum addresses the importance of advocate and judiciary independence, ethical conduct, and training. The Forum supports human rights and collaborates with the Judges' Forum and other committees on litigation and trial topics. The Forum’s inaugural members include Bar Associations from England and Wales, Scotland, Ireland, South Africa, Australia, and Hong Kong, representing over 16,000 barristers and advocates. The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.

Health-related debates often emerge earlier in developed countries, but this does not mean they are irrelevant in developing nations, as diseases do not recognise borders. Thus, in a world driven by intense research and development, gene therapies have taken centre stage for companies, regulatory agencies and researchers alike. In countries, such as Chile, where the regulatory framework remains underdeveloped, discussions on the implementation of specific regulations in this field are critical, otherwise, not only will research be hindered, but public health may also be put at risk.
The Diversity and Equality Law Committee includes private practitioners, in-house attorneys, and academics working with corporate clients on issues like pay equity, anti-discrimination, and LGBTQ+ rights. Members come from leading law firms, corporations, and various perspectives. The Committee publishes an annual newsletter highlighting new developments and issues of interest. The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. The Committee collaborates with the Employment and Industrial Relations Law Committee, the Immigration and Nationality Law Committee , and the Global Employment Institute.

As the Covid-19 pandemic continues to have an impact on our economy and social structures, it comes as no surprise that the way people work – and the digital tools used – differ substantially from our experience of pre-pandemic work. Across the globe, organisations are extending a suite of remote work options, including full-time remote work, hybrid remote work and flexible personalised plans. The legal profession is no exception to this trend, and in facilitating the shift, a variety of digital tools and services have been implemented to optimise the experience of remote legal work. These tools and services include virtual meeting platforms, digital hearing and filing platforms for courts, e-signatures, digital document review and e-discovery. The international uptake of digital tools and services in legal work signals a shift towards a new ‘normal’ in the profession. While being a lawyer was once synonymous with paper stacks and extensive physical libraries, digital tools and services have made the same world available through one’s laptop. The sustainability of the shift and our new ‘normal’ is also due in part to legislative reforms during the height of the pandemic that enabled an increased use of digital tools and services, and which in some cases continue to be in effect today. This article will examine how several jurisdictions, namely Australia, Belgium, India, Italy, Sweden and the United Kingdom, adapted their legislative frameworks to facilitate remote work, the impact of remote work on the legal profession, the various innovations adopted in the context of the pandemic and whether such innovations and associated changes were maintained after the lifting of associated restrictions.
This panel will examine the global phenomenon of the deliberate use of trade measures—tariffs, non-tariff barriers, sanctions, export controls, and other instruments, not as neutral regulatory tools but as instruments of geopolitical power.

The mission and focus of the committee is to provide a platform for lawyers practising immigration laws to receive input and update about the immigration laws of their country and also immigration laws and procedures of other jurisdictions. This article provides an overview of the China International Commercial Court (CICC) and its ‘one-stop’ platform for diversified international dispute resolution, as well as the new developments and benefits that this brings to users of arbitration in Hong Kong, in particular at the Hong Kong International Arbitration Centre (HKIAC). It begins by introducing the purpose of CICC’s establishment, the composition of the CICC, and the functions of the CICC. It then introduces the significance of the HKIAC’s inclusion into the CICC’s ‘one-stop’ platform, as the HKIAC is the only arbitral institution outside Mainland China to be so included. This article explains the existing mechanisms and practices through which arbitration users in an appropriate Hong Kong-seated arbitration may seek interim relief and enforcement of arbitral awards in Mainland China. Finally, this article explores the potential developments for users through the CICC’s new mechanisms and their likely impact.
The Academic and Professional Development Committee connects law schools, legal professionals, and the IBA. We aim to enhance the quality of lawyers worldwide, modernise legal practice, and attract top talent to the profession. We engage directly with law schools, helping students prepare for international practice, and support IBA initiatives to strengthen local Bars globally.

Carbon taxes and cross-border trade: greening trade with taxes?
The Poverty and Social Development Committee, builds on years of work under various IBA auspices. We engage the legal profession to contribute to UN Sustainability Goal #1: Eradicating Poverty. Our committee advocates for using law to protect individuals and communities from poverty, promoting well-being. We believe legal professionals have a duty to create and apply law for good, preventing exploitation and mitigating harm. Planned projects include a podcast, a practical book for lawyers, a session at the IBA Annual Conference, and supporting NGOs focused on poverty eradication. We invite members to join our efforts.
The delivery of legal services is going through rapid changes and there are various factors that contribute to these changes. They include technological innovation, changes in the business environment and globalisation. For lawyers to thrive despite the changes in the legal industry and in the delivery of legal services, they must develop new approaches.
The rise in the frequency of online cross-border legal services, already in evidence before the pandemic but doubtless increased by home working and travel restrictions during the pandemic, poses challenging questions about whether bars’ existing regulation of foreign lawyers, often based on their physical presence, needs to be reconsidered in the light of digital advances.

Very few legal fields face the revolutionary changes that employment and industrial relations laws do. Issues such as technology, human rights, globalisation, corporate citizenship and increased movements of people have created unprecedented legal complexity as they interact with traditional laws often formulated decades ago. As the largest of the Human Resource Section Committees of the IBA, the purpose of the Committee is the identification, technical analysis and proactive management of national, regional and global developments in these rapidly evolving fields. The Committee takes a ‘cutting edge’ approach to its selection of topics and speakers and draws upon the combined experience of its officers and panellists to present the members with innovative solutions to the employment law problems of today.

The rise of the digital economy in the second decade of the 21st century is significantly transforming the global financial markets.
The main areas are patents, trade marks, copyright, trade secrets and unfair competition. Allied to these are a number of related areas including data protection, database protection, privacy, design rights, domain names and the like.
In the entertainment law area the key focus is on the creation, provision and delivery of content in relation to print, films, broadcasts, cable programmes, musical works and sound recordings. There is also involvement with media law including defamation and privacy and authors' rights in a more general sense.

This paper analyses Ukraine’s digital content law that has been recently enacted to implement the European Union Directive (EU) 2019/770 on certain aspects concerning contracts for the supply of digital content and digital services. It examines the scope of the new legal framework, detailing the key obligations imposed on service providers, as well as the enforcement mechanisms and potential penalties for non-compliance. Additionally, the paper evaluates anticipated regulatory developments necessary for the full operation of the law.
International trade in legal services involves the cross-border provision of legal expertise through advisory services, dispute resolution, intellectual property protection, and regulatory compliance.
Internationalisation Conference: helping local lawyers with the internationalisation of legal practice
The Forum for Government and Public Lawyers provides a platform for government and public lawyers worldwide. As the global voice of the legal profession, the IBA supports these lawyers and connects them with both public and private sector practitioners. The Forum focuses on the role of government and public lawyers, covering public service values, ethics, specialist skills, and public international law developments. Membership is open to Bar Associations that are IBA members and individual members of any Division. The Forum is especially relevant to practitioners working in government or public entities at domestic, regional, or international levels.
In this article, the importance of pro bono legal services is highlighted in public interest matters regarding freedom of expression. The article reviews the introduction of a Strategic Litigation Against Public Participation (SLAPP) suit defence in a defamation suit against environmental defendants in South Africa.
This session will cover the different ways legal services cross national borders and how the World Trade Organisation, national governments and regulators have sought to understand, structure and regulate the reality of international legal practice.
Internationalisation seminar: helping lawyers access international legal markets or expand their practice to foreign jurisdictions
The Committee addresses, among others, issues as diverse as sustainable development, biodiversity, air, water, groundwater and waste regulation, climate change, safety in the workplace, protection of endangered species, food safety, environment and trade.

Arbitration is widely accepted as an effective dispute resolution mechanism for international construction disputes. This article will explore the extent to which various institutional rules have developed in a way that addresses the peculiar needs of disputants in the construction industry. The article shall briefly examine three of those specific needs and show how each has (or has not) been addressed by certain institutions. First, it will consider issues related to the cost and duration of construction arbitrations, specifically, procedural expedience including expedited procedures, procedures for securing interim relief and the correlation between high quantum claims and high arbitration costs. This article will then explore the suitability of existing discovery procedures for construction disputes. Finally, it will address issues that arise when, as is often the case, multiple parties or agreements are involved in a construction dispute. For each one of these needs, this article will seek to draw some tentative conclusions as to the extent to which certain institutional rules may arguably provide some tactical advantage to employers or contractors/subcontractors on construction projects, should they encounter a dispute that must be resolved by arbitration.

Biennial IBA African Regional Forum Conference - The leading-edge lawyer: Integrating technology, deciphering trends, and embracing ESG-driven transformative learning
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.

The Turkish Collective Bargaining Agreements Law establishes distinct thresholds for determining a trade union’s eligibility to negotiate and conclude collective agreements. Multiple work locations can be collectively considered as a single workplace if they present in the form of a ‘connected place’. Conversely, an enterprise refers to a broader unit comprising multiple workplaces, potentially spanning different sectors, all under a single employer’s ownership and control.
The Healthcare and Life Sciences Law Committee addresses legal issues in the healthcare and life sciences sectors, such as medicine, intellectual property, biotech, bioethics, regulatory matters, and scientific developments. With a dynamic, diverse, and growing membership, the Committee fosters collaboration to tackle industry challenges, such as increased competition and regulatory changes.
We provide a platform for discussion, sharing knowledge, and updating members on key developments. Given the fact that war in Ukraine and consequent sanctions are affecting Italian commercial transactions, the purpose of this article is to examine the remedies provided by Italian law to contractual parties being in an ‘emergency situation’ and to understand if such remedies are (still) applicable in the current context of the Russian-Ukrainian conflict.
